REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF JULY 4, 1983.

SUBJECT: CLOSURE AND CONVEYANCE OF A PORTION OF
CLARKE STREET (UNOPENED) WEST OF MILL STREET, j
BETWEEN BLOCKS ' I ' AND 'N' , HANNING'S PLAN,
VILLAGE OF NEWCASTLE.
RECOMMENDATION:
It is respectfully recommended:
1 . That Report WD-61-83 be received; and ,
2. That the unopened portion of Clarke Street, west of Mill
Street, between Blocks ' I ' and 'N' according to C.G. Hanning's
plan of the Village of Newcastle, be closed by by-law and
conveyed to the abutting owners; and ,
3. That the value of the lands involved be established in the
amount of $2,500. 00 (Twenty-Five Hundred Dollars) per acre; j

and ,
4. That Staff be authorized to complete the procedure for the
closure and conveyance of this road allowance, in accordance
with Town Policy.

BACKGROUND AND REPORT:
In January, 1983 , a Petition for the closure and conveyance of the
unopened portion of Clarke Street, between Blocks ' I ' and 'N' ,
C.G. Hanning's Plan of the Village of Newcastle, was received. The
WD-61-83 - 2 -
Solicitor for the Petitioners was advised of, and has complied
with, Town Policy, and the applicants have accepted the terms
and conditions detailed therein.
The area of land comprising this particular section of Clarke
Street is slightly less than a quarter of an acre, and members
of the same family own lands on either side of the right-of-way.
Town Policy states that an Appraisal of Land Value must be
obtained , prior to the sale of any Municipal road allowances.
In this particular instance, it is felt that acquiring an
Appraisal would be an unjustified expense for the applicants ,
and the value of the land can be based on the established
value of another section of Clarke Street , which was closed
and conveyed by the Town in 1980. This was for the figure of
$2,500. 00 per acre. The area of the subject lands totals
only 10 ,850 square feet, of which the northerly abutting owner
would be entitled to 6 ,210 square feet ( . 1425 acres) and the
southerly owner 4,640 square feet ( .1065 acres) ; based on the
value of $2,500/acre, the lands costs to the Petitioners would
be $356. 25 and $266. 25 respectively.

For the closure and conveyance of the Municipal Road Allowance
situated :
In Lot 10, Block I , Lot 9, Block N , in the former Township
of Clarke , now the Town of Newcastle .
We the undersigned , being the owners of property abutting the
abovementioned road allowance, do hereby petition the Council of the
Town of Newcastle to close same , by by- law , and convey the lands thus
gained , in accordance with the terms and conditions of the Municipal
Act, R . S . O.
Attached to this petition is a survey together with an Appraisal
of Land Value prepared by
We hereby agree that , upon Council approval of our petition , we
will register the Survey , and will accept the responsibility for any
costs involved in finalizing any and all transactions , as apportioned
in accordance with the size of the parcels of land gained .
We further agree to pay to the Town of Newcastle the sum of
Two Hundred and Fifty Dollars for the administration of this petition .
