It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 136 -96 be received; and
2. THAT the attached by -law amending the Sign By -law be approved.
REPORT:
1. By letter dated September 27, 1996, the Kaitlin Group requested the Municipality
to grant an exemption to the Sign By -law to permit a promotional sign on the
south side of Highway No. 2, west of Green Road, for the purpose of advertising
a housing development.
2. The letter is attached herein and sets out the reasons for the request for
exemption.
3. The current Sign By -law stipulates a maximum size of 269 square feet for a
promotional sign whereas the proposed sign is 348 square feet, exceeding the
By -law by approximately 29 %.

4. Staff reviewed the request and visited the site and are of the opinion that the
request for exemption is reasonable. This is primarily due to the fact that the
existing grade of the site is about 12 to 15 feet below the pavement of Highway
No. 2. As a result, the sign was raised to a height to make it visible to the
motorists. If not for the significant grade difference, the additional height, and
thus the additional size requested, would not be necessary.
5. Due to the unusual circumstance cited above, staff recommend the request for
exemption be granted. To effect the exemption, an amending by -law to the Sign
By -law is required. Said amending By -law is attached herein for Council's
approval.

Dear Sir,
Ite: Sign Installation `Clarington Corners' Development
As you are aware, we are now about to commence with the marketing program for our
newest project, `Clarington Corners', In the Municipality, which will eventually provide
approximately 400 new homes in this community,
With the grand opening slated for this weekend, we have recently constructed a
magnificent model home at the eastern edge of the property's frontage on Ifighway #2, In
order to announce the house as a model /sales office we also had a sign erected to on the
west side of the house, approximately 4,5 metres south of the property line
The sign was designed to be taller than we would normally use for a couple of reasons,
Firstly, these signs normally have a 6' skirt of wood lattice from the ground level to avoid
unsightly gaps at that lower end, Therefore, the sign itself does not begin until
approximately 6' above grade level, In this case, rather than lattice, we had a picket fence
design painted along the bottom,
Secondly, the sign became elongated at the top end because of the need to create a logo
for the project ( the oval logo), Had the logo been eliminated, the sign would have easily
fit within the normal by -law parameters.
Finally, the elevation of the site and the area of the sign is approximately 15' below the
pavement elevation of the highway in that area, Thus the effective height of the sign
relative to the eye level of the highway drivers is quite a bit lower than the actual height of
the sign in its location,

In view of the above, we would then graciously request that the Municipality permit an
exception to their sign by -law to allow this sign to remain as it currently is.
A completed sign application has been enclosed.

BY -LAW 96-
being a By -law to amend the Sign By -law
WHEREAS Kaitlin Group requested an exemption to the Sign By -law 76 -25;
WHEREAS Council deems it appropriate to grant such an exemption;
NOW THEREFORE, the Council of the Municipality of Clarington enacted as follows:
1. THAT By -law 76 -25 be amended by adding a new Condition 11 under Section 11
as follows:
"11.1 Defined Area
The lands subject to this special condition comprised of land in Lot 17,
Concession 1, former Darlington Township, specifically in a location
adjacent to Highway No. 2 as it pertains to a promotional ground sign in
association with a housing development.
11.2 Permitted Signs
Notwithstanding any other provisions to the contrary, a ground promotional
sign having a maximum sign area of 350 sq,ft. shall be permitted within the
defined area.
