JOE MARK, R.R. # 1, NEWTONVILLE REQUEST FOR IMPROVEMENTS TO THE UNOPENED ROAD ALLOWANCE - CONCESSION ROAD 3, FORMER CLARKE RECOMMENDATIONS: It is respectfully recommended: tl 60,S c 1. That this report be received; and, 2. That Mr. Joe Mark be granted permission to install a cross road culvert and place granular fill on the unopened road allowance between Concession Road 2 and 3, former Clarke Township, to gain access to his property; and, 3. That the Public Works Department issue the required Road Occupancy Permit for such work; and, 4. That Mr. Joe Mark be advised of Council's decision. ....2 Page 2 Report No. WD -60 -86 REPORT: On June 9, 1986, Mr. Joe Mark appeared as a delegation to Council and outlined his concerns with respect to access over 'the unmaintained portion of the road allowance between Concessions 2 and 3, Lots 9/10, former Clarke. Council Resolution C- 507 -86 referred the Joe Mark request to Public Works for review and report. The subject road allowance is classified as unopen and in accordance with Town Policy for Unimproved Roads, an unopen road is a municipally owned road allowance laid out as part of the original municipal survey where there is no evidence that public funds have been expended to open same, although a passable earth trail may exist. The policy further states that no maintenance shall be provided by the Town on such roads. Division III staff have reviewed the subject road travelling west of Regional Road 18 and advise that, to the best of their knowledge, no public funds or municipal equipment have been directed to this road. As well, they concur with Mr. Mark in that a culvert in the low swampy area and several loads of gravel fill would make the dirt road more usable. However, if Committee and Council intend this road to remain in the "unopened category ", no public funds should be spent to upgrade its condition. To accommodate Mr. Joe Mark's requirements to gain access over this road to his wood lot, it would not be unreasonable to authorize him to perform the necessary work at his own expense, by issuance of a Road Occupancy Permit. ....3 6 ( ) Page 3 Report No. WD -60 -86 Road Occupancy Permits have been authorized and issued in other situations similar to this where property owners require drainage works and access across an unopened road allowance. Mr. Joe Mark, R.R. 1, Newtonville, LOA 1JO, was present to ask the Council to have the Public Works Department install a used or new culvert in a section of the unopened road allowance in the 3rd Concession of Clarke, abutting his property; then dump 1 or 2 loads of gravel fill onto the road in this area and level it off. He also requests that the Town make a used culvert available to him and a supply of gravel fill. He has the equipment to install the culvert; to truck the gravel and level off the road. Mr. Mark is making this request because this unopened road allowance is the only access he has to approximately 45 acres of woodland at the back of his 200 acre farm. This land is separated from his main farm by Foster Creek. The lumber, firewood and fence posts derived from this land is vital to the maintenance and building plans of his farm. Approximately 100 feet of the road allowance extends through a low swampy area created by water run -off from the hills. Improvement of the unopened road would make the right -of -way more passable for his farm equipment and any fire equipment if the need arises.
