REPORT #: WD -8 -86 FILE #: DC -32 -3 SL BJECT: PROBLEMS RELATING TO GEARING FARMS SUBDIVISION, SPECIFICALLY KRESIA LANE. RECOMMENDATIONS: It is respectfully recommended: 1. That this report be received; and, 2. That staff be directed to, in accordance with the requirements specified in the subdivision agreement between the Town and Gearing Farms Ltd., take the necessary actions to correct drainage and signage problems on Kresia Lane at the cost of the developer; and, 3. That funds required for such works be recovered by drawing down on the letter of credit held by the Town. ....2 Page 2 Report No. WD -8 -86 REPORT: l Members who have been on Council before are familiar with problems experienced in the Gearing Farm rural estate subdivision. Prior to all of the requirements having been met for an authorization to commence work in the subdivision, the developer undertook to construct works. These works were incorrectly constructed and even after the requirements for authorization to commence had been met, there was a considerable time lapse before deficiencies were corrected. On numerous occasions since, problems have been drawn to the attention of the Works Department and we have directed the developer's consultant to correct them, however, response has been poor. Attached is a letter from residents on Kresia Lane indicating a number of items which require correction. Ditches cannot properly accommodate drainage so that their maintenance by homeowners is impossible. Water ponds and creates a nuisance. Regrading with proper slopes will be required and again, despite notification by the Works Department, corrective measures have not been undertaken. After following proper procedures as stipulated in the subdivision agreement, staff will be in a position to perform corrective works. The Town still holds performance guarantee in the form of a letter of credit for such works and can draw funds from it to pay associated costs. The lack of street and stop signs is a problem and, again, staff can attend to such deficiencies. .....3 Page 3 Report No. WD -8 -86 At the time of the letter from residents, street lights had been installed but not energized. Since then power has been provided so that the lights function as required. Promotional signs by custom builders have been left on Kresia Lane even though the builders are not active in the area. These create an eyesore for residents as well as generate traffic by "curiosity seekers ". This does create some concern from residents about the security of the area. In summary, the identified problems have existed for a considerable time and many attempts have been made to have them corrected. HERITAGE FARM RATE PAYERS ASSOCIATION TO: Mr. Ron Dupuis, Director of Public Works FROM: Residents of Kresia Lane DATE: December 18th, 1985 SUBJECT: Incomplete work | The following is a list of the work which to date remains incomplete in this ,Estate Development'. During the past six months, the developer Mr. Paul Gearing (P.K. Developments Inc.) has been notified of our concerns, however very little has been accomplished. 1. The ditches do not provide adequate drainage. They are poorly maintained by the developer. We as a group have had to perform some work in order to provide the drainage that we now have. 2. We do now have a `Stop' and 'Street' sign. We have however requested a 'No through street' sign also. 3. 'Street Lighting' has been finally installed but is not connected. 4. There are still three advertising signs remaining in the cul-de-sac. These have become an unnecessary eyesore and do nothing to enhance the natural harmony of the area. We trust that these matters will be resolved quickly. �0 �.--
