REQUEST FROM NEWCASTLE LIMOSINE SERVICE FOR A LIMOSINE PARKING ZONE
ON THE WEST SIDE OF CHURCH STREET, JUST SOUTH OF KING STREET IN THE
FORMER VILLAGE OF NEWCASTLE.
RECOMMENDATIONS:
It is respectfully recommended:
1. That this report be received; and,
2. That Mr. David Hawke, President, Newcastle Limosine Service, be
advised that the Town considers it imprudent to designate a portion
of the Church Street right -of -way in Newcastle Village as a limosine
parking zone, and that this request has been denied.

Mr. David Hawke, President, Newcastle Limosine Service in Newcastle Village
has requested the designation of a limosine parking zone on the west side of
Church Street, just south of King Street. The request has been considered
and the area in question reviewed with the following derived as the basis
for denial.
1. The Director of Planning advises that Section 3.14 of the Town's
Zoning By -law requires the owners of buildings housing activities such
as the limosine service to provide parking spaces on site. From a
review of the premises at 75 King Street West, it was found that there
are parking spaces both to the rear and west of the building which
could be used by the limosine service.
2. The Town must exercise extreme caution in consistent application of
its by -laws and policies. The Town's parking by -law stipulates how
parking is regulated and does not make provision to assist private
enterprises. In fact, there are parking spaces adjacent to this
business which could be utilized in accordance with the by -law.
3. Notwithstanding the fact that this situation is somewhat different
than that at the intersection of North and King Streets, allowing
exclusive use of one parking space by Mr. Hawke would effectively
preclude its use by others and reduce by one the stock of parking
spaces available in the downtown area.

SLUECT: NEWCASTLE VILLAGE LIMOUSINE SERVICE
Further to your request at the Department Heads Meeting, I can
advise that Section 3.14 of the Town's Zoning By -law requires
that "the Owner of every building or structure erected or used for
any of the purposes hereinafter set forth, shall provide and
maintain, on the same lot and for the sole use of the owner,
occupant or other persons entering upon or making use of the said
premises, parking spaces and areas accordingly ".
Although existing buildings which predate the Zoning By -law may,
depending upon their use at the time of passage of the by -law, be
exempt from this requirement, the intent of the by -law is to
require property owner's to provide on site parking.
