SUBJECT: CORRESPONDENCE FROM CN REAL ESTATE T ENRLOTESI N& AN EASEMENT DORMER
THE ORIGINAL ROAD ALLOWANCE
TOWNSHIP OF CLARKE, FOR ACCESS TO A FIBRE OPTIC REPEATER BUILDING.
RECOMMENDATIONS:
It is respectfully recommended:
1. That this report be received; and,
2. That a by -law be passed authorizing the Mayor and Clerk to execute an
easement document with CN Rail allowing them access along the road
allowance between Lots 20 & 21, B.F.C., former Township of Clarke.
3, That all legal searches, documentation and plans to allow said easement
be the responsibility of CN Rail; and,
4.
That all costs to the Town associated with this transaction be borne by
CN Rail; and,
5. That CN Rail, c/o Mr. J.M. Mathurin,
Real Estate Marketing
Representative, CN Real Estate, Suite 920, 277 Front Street West,
Toronto, Ontario, M5V 2X4, be so advised.

REPORT:
The attached correspondence from CN Real Estate requests an easement for the
use of the closed road allowance between Lots 20 & 21, B.F.C., of the former
Township of Clarke, depicted on the attached plan. To the best of our
knowledge, these lands are still owned by the Town but do not serve a
specific purpose. Thus, an easement in favour of CN Rail would be
appropriate since it would not preclude use for other purposes. That
organization merely wishes to formalize its right to use the lands for
access to their facility.
Conditional on preparation of reference plans, title searches and other
documentation by CN Rail, it is recommended that their request be granted.

SUBJECT: ROAD ACCESS TO CNCP NEWCASTLE FIBRE OPTIC REPEATER BUILDING
We act of behalf of CNCP Telecommunications who have recently installed a
Fibre Optic Repeater building on CNR property in Lot 209 Broken Front
Concession of the former Township of Clarks now The Corporation of the Town
of Newcastle.
Vehicular access to the building is via what was considered to be a public
road allowance between Lots 20 and 21 which is now closed by 'By -Law' No.
1654 of the Old Clark Township in 1969.
It is believed that the Town of Newcastle has retained ownership of the
closed road allowance. If this is the case► we request from the Town, an
easement in perpetuity over said lands in favour of CNCP Telecommunications`
for access.to their building.
Attached for your information is a copy of CNCP Drawing No. 1310- 001.2427-
01 showing location of repeater building together with a portion of a CNR
right -of -way plan.
If additional information is required► please do not hesitate to contact
the undersigned.
