SUBJECT:
REQUEST FOR ENTRANCE FROM THE UNOPENED ROAD ALLOWANCE
PART LOT 4, CONCESSION 4, FORMER DARLINGTON - VEENSTRA
RECOMMENDATIONS:
It is respectfully recommended:
1. That this report be received; and,
2. That the request for an entrance to the unopened road allowance on
Part Lot 4, Concession 4, Darlington, be denied; and,
3. That Mr. Veenstra, 134 Elizabeth Crescent, Whitby, Ontario, L1N 3R7,
be advised of Council's action.
REPORT:
Mr. A. Veenstra has reportedly made an offer on an irregular piece of
land, Part Lot 4, Concession 4, Darlington, with frontage on Taunton Road.
Staff understands that the offer is subject to Mr. Veenstra being able to
build on said property.

Mr. Veenstra has approached the Region of Durham to obtain an entrance
permit to the property in question and has met with some reluctance on their
part to grant permission to install an entrance where Mr. Veenstra would
like it due to traffic safety concerns. The Region suggested that Mr.
Veenstra contact the Town of Newcastle about the possibility of obtaining
permission for an access to the unopened road allowance abutting the west
end of the property.
Mr. Veenstra has recently requested such an entrance and in accordance with
Town Policy regarding entrances and unopened roads, a letter denying the
request and a copy of the Town's Policy for "Entrances" was sent to Mr.
Veenstra. It is staff's position that to grant entrance at the requested
location, that being from the unopened road allowance, would be inconsistent
with previous decisions to deny similar requests and potential future
implications could result.
As a result of Mr. Veenstra's delegation and Council's referral to staff for
a report, I met with Mr. Veenstra on site. Mr. Veenstra indicated that
entrance from Taunton Road is preferred and that entrance from the Town's
road allowance is less desirable. However, there is a location on the
property where sight distance is only slightly less than the Region's
requirements and entrance to Taunton Road could possibly be reconsidered.
It is, therefore, recommended that the request for entrance to the Town's
unopened road allowance be denied.

RE: Your Request for Entrance to an Unopened Road
Allowance - Part 4, Concession 4, Darlington
We have reviewed your request for entrance on the above road
allowance and must advise you that Section 3 h) of the Town's
policy for Entrance clearly states that "an entrance permit will
not be granted for access or egress from:
i) an unmaintained road;
ii) an unopened or unimproved road or road allowance;
iii)a road or road allowance closed by by -law ".
For your information we have enclosed a copy of the Town's
Entrance Policy.
