REPORT #: WD -44 -86 FILE #: SLRECT: SPEED LIMIT ON NASH ROAD FROM TOWNLINE ROAD (REGIONAL ROAD 55) TO COURTICE ROAD (REGIONAL ROAD 34) RECOMMENDATIONS: It is respectfully recommended: 1. That this report be received; and, 2. That the speed limit on Nash Road from Townline Road (Regional Road 55) to Courtice Road (Regional Road 34) be lowered from 60 kilometres per hour to 50 kilometres per hour, and, 3. That By -law 79 -75, being a by -law to authorize speed limits on highways under the jurisdiction of the Town of Newcastle, be amended to reflect the change; and, 4. That the associated costs of changing the signs be charged to the Public Works Traffic Sign Account, Division 1. ....2 UI �La> Page 2 Report No. WD -44 -86 BACKGROUND: The Public Works Department has received several requests to reduce the speed limit on Nash Road from Townline Road to Courtice Road. In January, 1985, GPA Resolution 20 -85 requested that the Director of Public Works review and report on the feasibility of reducing the speed limit on Nash Road between Townline Road and Courtice Road from 60 km /h to 50 km /h. The present condition of Nash Road between Townline Road and Courtice Road is in a continuing state of repair. The abutting property and surrounding area is rapidly being developed and the traffic counts on Nash Road are increasing substantially. At the present time it is extremely difficult and dangerous to travel this portion of Nash Road at 60 km /h. As well, there are schools within the area and many pedestrians who must walk on the road's edge. In accordance with today's criteria, it would be in order to reduce the speed limit from 60 km /h to 50 km /h. The Highway Traffic Act which states that no person shall drive a motor vehicle at a greater rate of speed than 50 km /h on a highway within a city, town, village, police village, or built up area, provides the authority to sign this section of road accordingly. By -law 79 -75, being a by -law to authorize speed limits on highways under the jurisdiction of the Town of Newcastle would require that Schedule "B" which reads: ....3 Page 3 Report No. WD -44 -86 "SCHEDULE V PART I GEOGRAPHIC TOWNSHIP OF DARLINGTON Maximum Rate of Speed - 60 kilometres per hour COLUMN I COLUMN II COLUMN III Highway from to 1. Public Works staff have discussed this matter with the Region of Durham Traffic Division and Police Department who concur with these recommendations. It is, therefore, respectfully recommended that the speed limit on Nash Road from Townline road to Courtice Road be reduced to 50 km /h and the by -law be amended accordingly. DTG:jco May 12, 19 86. ( CO1t1101(ATION 0.11 '1111" TOWN OF N - I SY :I'l.: By -LAW NUMBER: 79-75 Being a By -Law to authorize Speed Limits on highways under the juris- diction of the Town of Newcastle. 4 WHEREAS Section 82 of the Highway Traffic Act (R.S.O. 1970, Chapter 202) authorizes the Council of a City, Town or Village, and the Trustees of a Police Village, by by -law to prescribe a rate of speed for motor vehicles driven on any highway or portion of highway under its jurisdiction: law of the .'i NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED as a by- Town of Newcastle through its Council thereof as follows: When any highway or portion of highway set out in Schedules A, B, C and U, appended hereto, is marked in compliance with the regulations under the Highway Tr nffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed i the Schedule. Traffic Act The penalties prov ided in Subsection 16 of Section 82 of the Highway shall apply to offences against this by -law. 77 -64 and 78 -66 and any other inconsistent by -laws insofar as By -Laws Nos. 76 -11, sire 1,<'reby they app ly to 11ig'hw,,ys under the jurisdiction of the Town of Newcastle repealed.
