REPORT #: WD -69 -86 FILE #: SUB,ECT: YEAR ROUND MAINTENANCE GIBBS ROAD, LOTS 2/3, CONCESSION 7, FORMER DARLINGTON TOWNSHIP RECOMMENDATIONS: It is respectfully recommended: 1. That this report be received; and, 2. That the Public Works Department provide year round maintenance on Gibbs Road from Concession Road 7 to approximately 1300 feet southerly, Lots 2/3, Concession 7, former Darlington; and, 3. That minor upgrading of the road be performed in order to facilitate 1986 and 1987 winter maintenance; and, 4. That Mr. & Mrs. Johann and the abutting property owners be so advised. ....2 Page 2 Report No. WD -69 -86 BACKGROUND & REPORT; Mr. & Mrs. Johann have requested year round road maintenance on the Gibb sideroad south from Concession Road 7 in the former Darlington Township. The Johanns would like to construct a permanent residence on their property, Part Lot 3, Concession 6. The present status of the access road to this property is somewhat confusing; the maps and Needs Study indicate the road is fully maintained, however, the road is signed unmaintained and receives only minimum summer maintenance. In view of recent legal opinions on other roads of similar status, it is staff's opinion that the municipality has an obligation to provide year round maintenance to a reasonable level of service to serve the established Schmid Farm. It appears that year round maintenance ceased when dwelling habits on the Schmid farm changed. To facilitate winter maintenance on the road minor upgrading is recommended. Town forces would perform minor brushing, gravel surfacing and the construction of a turnaround at the south limit. This upgrading would be funded from the 1986 Maintenance Budget. As well, the Johann correspondence indicates that residents have occupied the property adjacent and north of the Johann property for seven years. Building Department records indicate an application was made and approved in 1984 for a four person cottage on this particular parcel of land. Staff is concerned that unauthorized persons have been providing winter maintenance to gain access. This unauthorized maintenance creates an additional liability for the Town. ....3 Page 3 Report No. WD -69 -86 The road presently serves three parcels of land with two potentially permanent residential units. It is, therefore, recommended that the Public Works Department commence year round maintenance on Gibbs Road from Concession Road 7 southerly, for the 1986/87 Winter Season.
