REPORT #: WD -57 -86 FILE #: BOWMANUILLE AREA GARBAGE COLLECTION RECOMMENDATIONS: It is respectfully recommended- 1. That this report be received; and, 2. That staff pursue a plan to serve the commercial establishments with refuse collection by the use of disposal bins; and, 3. That the food stores and delicatessens, etc. (those businesses generating food scraps as waste), which do not have adequate storage facilities to accommodate once per week pick up be serviced by disposal bins, effective July 14, 1986; and, 4. That if any difficulties arise in the implementation of disposal bins for the week of July 14, 1986, the businesses in question will receive collection services on Monday and on Thursday until such time as disposal bin arrangements can be finalized; and, . ® >.2 Page 2 Report No. WD -57 -86 5. That in an effort to improve the efficiency of the residential collection, staff adhere to the provisions set out in By -law 82 -184 with respect to proper location, containerization and bundling of refuse left at the curb. REPORT: GPA # 576 -86 was passed at the G.P.A.C. Meeting of June 2, 1986, stating "that Councillors Wotten and Hubbard meet with the Chairman and Director of Public Works to discuss the garbage problem in the Bowmanville area ". This meeting was held on June 9, 1986, with Councillors Hamre, Wotten, Hubbard, Director, Gordon Ough and Deputy Director David Gray were in attendance. The Director was requested to review the current refuse collection arrangements, including the request and consideration of input from the Bowmanville B.I.A., and report back to G.P.A.C. As part of the discussions at the meeting, several items were presented for consideration: - the truck driver and lead hand involved with refuse collection thought that the 'old way' was better than the new way; - the B.I.A. were on record as considering once per week pick up, as specified in the by -law, unacceptable; - refuse was periodically being left on the streets over night because the volume was such that staff could not pick up the routes by quitting time and were not willing to work overtime to finish up; - the provisions in By -law 82 -184 regarding proper location, containerization and bundling of refuse, were not being observed (see By -law # 82 -184 attached); - liquid wastes were causing concern with respect to collection of refuse at the Bowmanville Memorial Hospital. ....3 Page 3 Report No. WD -57 -86 Discussions with the Chairman of the B.I.A., Mr. Webster, took place with respect to the suitability of disposal bins as an appropriate and improved method of refuse disposal. Mr. Webster was quite receptive to the use of disposal boxes in the B.I.A. area. I visited the Coronation Restaurant on Monday, the concerns of once per week pick up with the bins being placed in common areas was received established that if bins were not implemented, Thursday would likely satisfy the needs of tho scraps as waste. Further thought is required regarding the long term improvements of the refuse collection system, however, the recommendations in this report are intended to somewhat relieve the immediate concern with respect to commercial pick up and improve the efficiency of the residential pick up. For Council's information, I have attached a message which will be distributed to those residents who are not adhering to the by -law with respect to the proper location, containerization and bundling of refuse. The letter was previously endorsed in Report WD- 69 -85, however, it is being brought to your attention again since it is anticipated that some residents will feel compelled to contact their Council representatives to complain about a perceived reduction in service. ....4 Page 4 Report No. WD -57 -86 If Council has any suggested refinements to the message, it would be appropriate at this time to discuss them with staff. (Residents may take used oil and other liquids in marked containers to the Town of Newcastle Works Yard on Liberty Street South, Bowmanville, between 7:00 a.m. and 3:30 p.m., Monday to Friday). GJ 0 : j co THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NO. 82- 184 Being a by -law to regulate the handling and collection of garbage, rubbish, ashes and other waste the Corporation Municipal Collection areas of of the WHEREAS, Section 210 (83) of the Ontario Municipal Act, R.S.O. 1980, provides that, WHEREAS, b laws may be passed for establishing and maintaining a system for the collection, ther refuse d removal and disposal of garbage, ashes ndoupon such a� contracting d conditionsasrl�ay disposal of garbage, ashes and other se be considered expedient; ion of the Town of Newcastle, pursuant NOW THEREFORE, the Council of the Corporat to Section 210 (83) of the Ontario Municipal Act, R.S.O. 1980, ENACTS AS FOLLOWS: - l DEFINITIONS: For the purpose of this By -Law, the following words shall have the meaning given herein: (a) "Garbage" shall mean all rejected, abandoned or discarded food or table or kitchen waste material from the preparation of food, ashes, discarded paper products, newsprint, wearing apparel, floor sweepings, �. grass clippings and garden wastes, clippings from trees and shrubs, glass, crockery and metals. > >> (5) "Householder" shall mean any owner, occupant, lessee, tenant or any ,er srrn h�ivillq use, occupation and/or charge of any dwelling, hotel, I -�� ", public institution, restaurant, apartment house, office building, p service station, industrial building, commercial premises, store, shopping centre, or plaza or portion thereof or any other premises. (c1 "Dwelling Unit" shall mean a unit consisting of one or more rooms designed for use as a single housekeeping establishment. (d) "Dwelling" shall mean a detached building consisting of not more than three dwelling units. (e) "Food Dispensing Establishments" shall mean any restaurant, public dining room or other eating establishment. (f) "Commercial Premises" shall mean buildings or structures located in the commercial zones in the Municipality of the Town of Newcastle. (cr) "Street" shall mean any public highway, road, lane, alley, square, . ,_ ! _ "_ T--- „f NPwra S tl e . I . (h) "Town" shall mean the Municipal Corporation of the Town of Newcastle. (i) "Director of Public Works" shall mean the Director of Public Works of the Town of Newcastle or his authorized representative. (j) By -Law Enforcement Officer" shall mean the By -Law Enforcement Officer for the Corporation of the Town of Newcastle or any other officer authorized by the Corporation of the Town of Newcastle for the enforcement of By -Laws in the Town of Newcastle. (k) "Apartment Building" means a building which consists of four or more dwelling units other than flats, but the term shall not include a group dwelling. 2. 3. COLLECTION AREAS The limits of the collections areas shall be as shown on the schedules attached to this by -law:- Bowrnanville Schedule "A" Orono Schedule "B" Newcastle Schedule "C" The Properties within the limits of the collection areas which are assessed as farmlands are excluded from the tax assessment base used to calculate the levy for this service. COLLECTOR'S RESPONSIBILITY (a) The Director of Public Works shall be responsible for the collection and removal of garbage by the Town. (b) The By -Law Enforcement Officer is hereby authorized and empowered to enforce the provisions of this By -Law. 4_ COLLLCTIUiI' PROCEDURE (a Subject to the provisions of this By - Law, the Town shall provide for the removal of garbage. (b) Subject to Section 4(d), 4(e), 6(b) and 8(b) collections shall be made from all premises according to the following schedule:- (i) From all dwellings and other premises not otherwise provided for, not more than once (1) per week. (ii) Frorir Food Dispensing Establishments as follows:- For all food dispensing establishments not otherwise provided for, not more than once (1) per week. From Commercial and Industrial premises as follows: - Not more than once (1) per week. ��� rig ThP Tnwn shall collect a combined total of not more than six (6) 4. By -Law No. 82- 184--°! 6 CC) 3 - receptacles or bundles per collection per dwelling unit or any other premises not otherwise provided for. (ii) The Town shall collect a combined total of not more than four (4) receptacles or bundles per collection per dwelling unit from any apartment building with six (6) or more dwelling units. (iii) The Town shall collect any quantity of garbage per collection from Conunercial Premises or Food Dispensing Establishments, except as hereunder provided for under Section 5. (d) Except by order of the Director of Public Works, no garbage collection vehicle owned, rented or operated under contract by the Town of Newcastle, shall enter a privately owned driveway or roadway or land or other private property forcollecting garbage or other waste material. Such order shall not be given unless it is feasible and economical for the Town to so enter private property. (e) Except by order of the Director of Public Works, no Town garbage collector or contractor shall be required to enter on any private property for the purpose of collecting garbage or other waste material. (f) The Town may, at the request and expense of a householder, or of any occupant of any building or part thereof, remove and dispose of garbage, ashes or refuse, over and above the quantity specified in Section 4 at a charge of $65.00 (Sixty -five dollars) per collection.. MATERIALS NOT COLLECTED BY THE TOWN All materials not collected by the Town shall be disposed of as directed by the Director of Public Works and at the expense of the consignee or owner of such materials so abandoned, condemned or rejected. The decision of the Director to Public I;orks shall be final as to quantities and class of material to be co'I L(c d. Except as provided for in Lection 10 of this By -Law, the following materials shall not be coi i ted '_hk, Torai of Newcastle or its contractor(s) . ( a ) Swill or other organic not properly drained or wrapped. ( b ) Liquid waste and pathogenic wastes from hospitals ( c ) Hay, straw or manure. e (d) Night soil and animal waste. (e) Any material which has become frozen to the receptacle and cannot be removed by shaking. (f) Industrial or trade waste including any abandoned, condemned or rejected product, or, waste material, builders' or contractors' refuse, and the stock of any wholesale or retail merchant. (g) Discarded truck or automobile parts, tires accessories from automotive service service stations or similar automotive estalishments. 5. V1.�.��� (h) Any material in receptacles or bundles which do not conform to Section 6(b) and 7(c) herein. (i) Discarded furnitureorappliances, except by special request, as set out in Section 4(f), (j) Hot ashes or any waste materials capable of starting fires. (k) Explosive or highly combustible materials. (1) Sod, earth, tree trunks and branches,stone, building materials or building rubbish, frozen containers, except from individual residence and in quantities of less than 40 (forty) pounds per specified receptacle. (m) Carcasses or parts thereof of any dog, cat, fowl or any other creature (with exception of bona fide kitchen waste). (n) Radioactive Material. 6. RECEPTACLES FOR GARBAGE (a) All qarbage or other refuse to be collected by the Town of Newcastle or its contractor(s) must be placed and kept in receptacles or containers in accordance with the regulations herein. (b) (i) Except as otherwise provided, every Householder shall provide sufficient receptacles of not more than two (2) cubic feet capacity which with the contents shall weigh not more than 40 (forty) pounds, and are satisfactory to the Director of Public Works for the deposit of garbage. (ii) Receptacles shall be covered, watertight containers, have suitable handles, and be not more than 30 inches high or 18 inches wide. (iii) Non- returnable plastic bags of 2.75 cubic foot maximum capacity with a minimum of 1.5 mil thickness and capable of being lifted with 40 pounds of contents may also be used. (iv) Receptacles which are smaller at the top than at the bottom, paper boxes, 5 gallon paint cans, oil drums, lard cans and other similar containers shall not be used unless such containers are intended for disposal with contents and are securely closed, covered or otherwise rendered unlikely to permit the contents to be scattered. (v) Grass clippings, garden waste and clippings from trees and shrubs may be placed in returnable open baskets of at least bushel capacity. 0 0 7. - 5- (b) (vi) Every Householder shall or points to be served Section 8(b). V place all such receptacles at the point on the days of collection as provided in (vii) Ashes shall be cold and shall be placed in approved containers as specified in paragraph 6(b(ii), Page 4. (c) No receptacle shall be filled above the top level, and all receptacles, except as provided for in Section 6(b) shall be provided with good watertight covers which shall be properly placed and maintained on such receptacles at all times, so as to prevent access by insects or the escape of odours therefrom. (d) Owners and Occup-ers of Commercial premises and apartments with four (4) or more Dwelling Units shall provide garbage storage containers for every premises which shall be large enough to hold the number of receptacles as specified in Clause 4(c) which that premises would require. These shall be approved in structure and maintenance by the Durham Region Health Unit and placed in a location approved by the Director of Public Works. PREPARATION OF GARBAGE FOR COLLECTION (a) Garbage must be drained of all liquid and securely wrapped before being placed in receptacles. (b) Such articles as crates, newspapers., packing materials,brush, bedding and materials of like nature may be collected inalike manner as garbage, but must be securely tied in compact bundles or parcels, not exceeding 3 feet in any dimension or weighing over 40 pounds or placed in sufficient receptacles of the type specified in Section 6(b). (c) Garden receptacles and all waste emanating from any building shall at all times be kept on a portion of the householders' premises. All such receptacles and waste shall be placed at such points to be served on the days of collection as may be indicated by the Director of Public Works, in order to facilitate collection. (d) Such articles as bandages, poultices, dressings, medicines, vitamins, drugs, vaccines and syringes from drug stores, medical and dental buildings and hospitals must be securely wrapped in watertight packaging so as not to present a hazard to collection personnel. All such bundles or parcels must conform to weights and dimensions as provided for under Section 6(b). (e) Brush and tree and garden and lawn cuttings shall be placed in plastic bags or cardboard cartons securely tied, or compacted and tied in bundles having a weight not exceeding 40 pounds and no dimension exceedinq 3 feet. PLACING RECEPTACLES FOR COLLECTION BY THE TOWN (a) Collection by the Town of garbage if other waste material shall be made only in the areas and on the days which are designated by the Director of Public Works. - 6 - (b) Material set out for collection shall normally be placed as close as possible to the edge of the roadway, without obstructing the roadway, sidewalk or footpath. In any case, the Director of Public Works has the power to designate the precise point at which the material shall be placed for collection. (c) Material for collection shall not be placed on a street or other public property before 6:00 p.m. on the day preceding normal collection (d) Material for collection shall be placed at the prescribed location for collection not later than 7:00 a.m. on the normal collection day or pick- up will not be guaranteed. (e) Garbage collection service shall not be provided on proclaimed holidays, but collection'shall normally be made on the following regular business day. (f) Empty receptacles and all material which the collector refuses must be removed from the street or from public property by the occupant of the premises from which it was taken before 8:00 p.m. on the same day that the garbage is collected or the material refused. 9. CLEAN -UP WEEK SPECIAL COLLECTION SERVICES Special collection may be provided to Dwelling Units in the Town of Newcastle by Resolution of Council. 10. The cost of collecting garbage, ashes and other refuse, as provided for in this By -Law shall be charged to the benefitting property owners; that is, the owners of property as designated in Section 2 of this By -Law and located in collection areas as shown on Schedules "A ", "B" and "C ". 11. REPEAL OF EXISTING BY -LAWS By -Laws 78- 51,78 -34 and 80 -10 are hereby repealed. 12. PENALTIES (a) The provisions of this By -Law shall not relieve any person from compliance with any provisions of the Public Health Act or regulations prescribed by the Medical Officer of Health. - 7 - By -law read a first and second time this 23rd day of December 1982.
