REPORT:
At the Council Meeting of June 23, 1986, Resolution # C- 546 -86 was passed by
Council requesting, essentially, that the Director of Public Works monitor
and report back on the progress of work being done to correct the ditch
problems on Kresia Lane.
On January 21, 1986, a letter was sent to Paul Gearing directing him to
remove some signage and to correct the drainage problems by June 1, 1986, or
the Town would do the work at the owners expense.

The method agreed upon to correct the drainage problems involved laying a
drainage pipe in the bottom of the ditch and connecting it to the storm
sewer work planned for the east side of Tooleys Road.
As the June 1st deadline past, I approached Paul Gearing's consultant to
enquire about Mr. Gearing's intentions with respect to the matter. However,
the June 1st completion date then became a June 16th start date due to
restrictions on performing storm sewer work in Farewell Creek prior to June
15th as advised by CLOCA on behalf of the Ministry of Natural Resources.
Staff received assurances from Mr. Gearing that work would commence the week
of June 16th.
On the Friday of the week of June 16th, some work was done to improve the
efficiency of the ditches, however, the ditches remain a mess and an
eyesore. To -date, July 2, 1986, no further work has been done.
On July 4, 1986, a registered letter was sent to Mr. Gearing advising him
that the Town is proceeding to make the necessary arrangements for
completion of the required works.

This will serve as notice, as stipulated in paragraph 5.17
Incomplete or Faulty Work, in the above noted agreement.
A letter sent to you by the former Director of Public Works on
January 21, 1986, in which you were directed to complete, among
other things, some roadside ditching improvements by July 1st of
this year. It is acknowledged that since CLOCA advised that you
were not to perform storm sewer outfall works in the creek until
after June 15th, 1986, due to regulations protecting fish
spawning season, an extension of the deadline to June 16th was
appropriate. Further, on Wednesday, June 4th and, again, in a
meeting in my office Friday, June 6th with Councillor Hubbard,
Tony Cannella and myself, regarding your latest development area
off Pebblestone Road., you assured me that you would complete the
ditch improvements not later than the week of June 16th. On
June 20, 1986, some temporary work was performed, however, the
ditches remain in an unsatisfactory condition. On Tuesday, June
24, 1986, you assured me that you had contracted a firm to carry
out the works and would proceed forthwith. To date, no further
action has taken place.

Please be advised that pursuant to the letter of notice of
January 23, 1986, and Council direction, that due to the lack of
productive attention given this matter, the Town has no
alternative but to proceed with the necessary arrangements to
complete the works and will draw down funds to cover associated
costs from the letter of credit we hold, as provided in
paragraph 3.7, of the subdivision agreement.

And further that Mr. Ough submit a progress report to Council,”

This will serve as notice as stipulated in paragraph 5.17,
Incomplete or Faulty Work, in the above noted agreement.
The Town has had repeated complaints from residents on Kresia
Lane regarding roadside ditches which have been constructed in a
manner such that they are always subject to wetness. In
addition, promotional signs placed by builders who have
purchased lots from you have become an eyesore to residents and
attracts more traffic than is desirable to the area.
With respect to the signs, unless they are removed immr:ri,,tely,
we will have them removed and assess charges to you Wits.

Any delays in achieving these deadlines, unless approved by this
department, will result in our performing the work and drawing
funds for associated costs from the letters of credit we hold,
as provided in paragraph 3.7 of the subject agreement.
I am aware that through development of lands you own in the
vicinity, the drainage problem is intended to be addressed,
however, we must ensure that there are no further delays in
correcting the problems.
