Please be advised that Brantford City Council at its meeting held January 30, 2024 adopted the
following:
12.1.10 Reliable and Accessible Public Rail Transit - CN Rail
WHEREAS Canadians deserve access to reliable and efficient passenger rail service;
and
WHEREAS in 2021 the Canadian Minister of Transportation announced that the
federal government would be pursuing opportunities to enhance passenger rail
services in southwestern Ontario; and
WHEREAS passengers continue to experience long delays and disruptions to service,
related to interruptions caused by CN Rail's freight systems and refusal to give priority
to passenger rail service; and
WHEREAS Metrolinx and VIA, in extending or improving commuter train service from
Aldershot through to Brantford, Woodstock, Ingersoll and London, is reliant on access
to CN rail lines; and
WHEREAS CN Rail views increased passenger rail service on its lines as being
incompatible with its primary business of moving freight and is unlikely to cooperate in
extending commuter rail service on its lines in southwestern Ontario without direction
from the federal government; and
WHEREAS CN Rail has shown a disregard for Municipal property maintenance
standards in respect to the maintenance of their rail lines and blocks municipalities
attempts to enforce municipal property standards upon their rail lines; and

WHEREAS CN Rail's consistent failure to provide a timely response to development
applications adjacent to rail right of ways imposes inordinate delays and expense for
builders and municipalities, further jeopardizing the ability of municipalities to address
the housing crisis; and
WHEREAS there is a complete lack of federal regulations providing VIA and Metrolinx
with any degree of priority or guaranteed access to rail rights of way or directing CN
Rail to work cooperatively with municipalities;
AND WHEREAS The City of Brantford CALLS UPON the Federal Government to assist
other levels of government as they take steps address the need for reliable and
accessible public rail transit, timely processing of housing developments and the
prompt and equitable enforcement of municipal property standards;
NOW THEREFORE THE COUNCIL OF THE CITY OF BRANTFORD requests that the
Federal Government enact the necessary legislative and regulatory provisions:
providing VIA and Metrolinx with priority right of way over freight rail lines, and
further;
directing CN Rail to work positively and cooperatively with municipal and provincial
governments in the processing of land development applications, and the prompt
and timely enforcement of municipal property standards;
AND THAT a copy of this resolution be forwarded to all Ontario Municipalities; and to
the Member of Provincial Parliament Will Bouma, Member of Parliament Larry Brock,
Federal Minister of Transport Pablo Rodriguez, Provincial Minister of Transportation
Prabmeet Singh Sarkaria, President and CEO at Metrolinx, President and Chief
Executive Officer of VIA Rail Canada Inc and President and Chief Executive Officer of
CN.

Whereas in 2015 the City of Greater Sudbury ("Sudbury') entered into
a contract with a contractor to complete a project in its downtown core;
And whereas, the contract provided that the contractor would be the
constructor for the project as that term is defined in the Occupational
Health and Safety Act (the "Act');
And whereas, an employee of the constructor operating a grader on
the project struck and killed a pedestrian;
And whereas, Sudbury was charged with offences under the Act as
the constructor and the employer;
And whereas, after being acquitted at trial and on appeal, the Ontario
Court of Appeal, in a decision issued on April 23, 2021, found Sudbury
to be liable for contraventions of the Construction Regulations as an
employer as it employed quality control inspectors to monitor the
quality of work on the project from time -to -time;
And whereas, the Supreme Court of Canada, in a decision issued on
November 10, 2023, was evenly divided 4-4 on the issue resulting in
the dismissal of Sudbury's appeal;
And whereas, the consequence of this decision is that municipalities
in Ontario, as well as all other owners of property in the province, who
wish to undertake construction, are subject to being charged and
convicted as an employer for offences in relation to project sites for
which they have no control and have, in accordance with the Act,
contracted with an entity to assume oversight and authority over the
work on such site as the constructor;

And whereas, the potential of an owner being charged as an employer
as that term is defined in the Act in circumstances where it has
engaged a constructor disregards and renders meaningless the
owner -constructor provisions contained in the Act and presents an
unacceptable level of increased risk and confusion for owners and
contractors throughout the province;
And whereas, The Regional Municipality of Peel believes that the
safety of workers is paramount however the safety of workers on

construction projects in Ontario is not increased by placing liability on

RE: return to combined ROMA and OGRA conferences
Dear ROMA & OGRA Board of Directors,
During the February 5, 2024 regular meeting of council, council in response to a notice of motion from
Deputy Mayor Joel Field the following resolution passed:

WHEREAS as a past attendee of combined conferences, it makes great sense for the OGRA & ROMA
conferences to be returned to a combined conference effort, not only financially for the municipality but
also for availability for participation of members of Council and staff; and
WHEREAS these conferences afford a vital opportunity for delegations with members of our provincial
parliament, returning to a combined conference provides a better respect to their availability and
participation; and
WHEREAS during the 2019 OGRA conference AGM a resolution was passed regarding the re-
establishment of an annual combined conference for both OGRA & ROMA; and
WHEREAS it is understandable that little movement has happened since the resolution at the 2019
OGRA conference AGM was passed, due to delays of the COVID-19 pandemic; and
WHEREAS not all persons who wish to attend can do so in person, that a hybrid participation option be
considered for the sessions;
NOW THEREFORE BE IT RESOLVED that the Council of the Town of Petrolia call upon both the ROMA &
OGRA boards to re-establish a combined OGRA & ROMA annual conference.
FURTHERMORE that this resolution be forwarded to Premier Doug Ford, Minister Paul Calandra, MPP
Bob Bailey and be circulated to Municipalities of Ontario; as amended

a) Town of Cobourg Stormwater Charges
There was a discussion among the board members with regards to the stormwater
charges. While the intent of the charges is understood as it relates to the Town of
Cobourg's asset management plan, staff pointed out that if all watershed municipalities
implemented similar charges, the GRCA would be paying around $1,800.000.00 which
amounts to approximately 50% of the 2024 preliminary budget.

Orono DBIA January 29,2024 meeting
Notes — Karen Lowery, Vice -Chair
The Municipality of Clarington is situated within the traditional and treaty territory of the
Mississaugas and Chippewas (chip-uh-WUH) of the Anishinabeg (uh-NISH-in-NAH-bek)
known today as the Williams Treaties First Nations.
Our work on these lands acknowledges their resilience and their longstanding
contributions to the area now known as the Municipality of Clarington.

Topic - Moving Forward - Orono as a Destination
Karen Lowery has spoken with Bonnie Wrightman and Rhonda Armour of CBOT and
with Laura Knox of Invest Clarington and requested help with promoting downtown
Orono moving forward. Both have been requested at the next Orono DBIA meeting in
February. Thoughts for moving forward and investing in the future of Orono
1. Possibly have the Mayor and Willie Woo at the next meeting with Margaret.
2. Use the Big Box Money - Available funds $32,000.00
3. Alison Dee with the Clarington Library has expressed an interest in coming to
BIA meetings and also using the library washrooms for public use. Sam was
helpful at the Halloween pumpkin walk.
4. Perry Kirkbride to check with the Orono Town Hall as to the feasibility of using
washrooms by side entrance for the public. Someone like Dan, with a Janitors
background to maintain the washrooms.
At present there are no public washrooms available. We are missing the bakery
business in town. Also closed is (Wood. The Bistro has never re -opened. There
are 5 storefronts empty at present.
5. Better Cross promotion with our downtown businesses and Business like
Calderwood House - Tea Room up the street, 1840 Farm House & Vineyard, Cat
World, Brimacombe, Co-op, etc. Orono Trail system, Orono Town Hall and the
Orono Arena.
6. Up -date the Orono Website.

7. Up -date the TV advertising at Orono Arena - Get the "how to" add on info from
Timothy Jackson.
8. Laura Knox to check on some Grant funding coming out on Feb.15tn
9. CBOT suggested having an appointed representative from the municipality to
collectively update things like the web sites. It has been pointed out that Timothy
Jackson is currently doing most of this.
10. Connect with the cyclist groups and have a coffee shop / gathering space up by
Spring.
11. Find the names and phone numbers of the landlords of retail spaces available
downtown - Karen Lowery to check - One of the longtime issues to renting
restaurant space are the ageing septic systems of properties and the larger
amount of water being used. People have expressed interest in renting space for
a restaurant, coffee shop , women's/men's clothing, if they could contact
landowners.
12. Marg Zwart to see if she can locate the owner of the old Mercer lot
13. Revisit Dog waste Stations in town and at the trail. It was suggested by
Margaret that maybe just a Post with a box of bags attached and situated by
current garbage bins could work over having the waste bins attached. Concern
as to who would collect the garbage.
14. EV charging station has been installed over at the library. We should have a
public notice and be on a website of "where to find" station's in Ontario. Like
"Charge Hub"
15. Connect with Sam Kent to see if a co-op p/u space for the farmers market would
work in one of the retail spaces. Jessie had a similar idea.
16.Orono bags with the current businesses and the farmers market listed on the
back - cross promotion - to be used by all. A simple sheet handed out each time
suggesting the different businesses to visit while in town.

19. Perry advising of Movie night at the town hall Feb. 02 at 7:00 pm - bring a
perishable item for the food bank.

downtown businesses were using the same septic company.. To check into

check with Timothy re social media request.
Next Meeting - Tuesday, February 20th, 2024 at 8:30 am at the Orono Town Hall to
start a discussion on the above with CBOT and Invest Clarington.

Safety and Decor:
The snowflake at Foodland has been flickering, the Municipality has
looked at it and determined there is no power supply issue with the outlet
but the best solution may be to unplug it for now.

There was lots of event content to share this month. On Instagram, our

new followers. Facebook had 29 new followers, post reach of 4597

It was well attended. Everything ran smoothly, they had lots of volunteers
and would like to thank the many sponsors that made it possible.
Santa Breakfast (Sunday, December 3rd, 2023 at 8-1lam)
It was a great morning, we had 321 people attend. Kids loved visiting Santa
and dancing to the live entertainment.

Working with Durham College and their Marketing contest in February. A
trophy and $500 will be awarded to a student in honour of Kevin Baker.

11. New Business:
The Remembrance Day wreaths and crosses will come down. Kevin at the
Hall will be asked.
The AGM will be Monday, January 15th, 6:00pm. Theresa will ask John at
the Snug if we can use the back room. Cost will be $20 per person. An
email will be sent to invite members of the BIA.
