Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 108 -96 be received;
2. THAT the zoning by -law amendment application submitted by Vanstone Mill Inc.
requesting removal of the Holding (H) symbol from the subject lands within Part
Lot 13, Concession 1, Bomanville be approved;
3. THAT the attached by -law be forwarded to Council for approval; and
4. THAT all interested parties listed in this report be advised of Council's decision.
1. BACKGROUND
1.1 In 1993, the Vanstone Mill, the Stable, and the tablelands on the east side of the
Bowmanville creek were re -zoned for commercial uses. A Holding (H) symbol
was placed on the lands to ensure the developer complied with conditions from
the Central Lake Ontario Conservation Authority and the Ministry of Natural
Resources for reduction /flood protection works for the Bowmanville Creek.
1.2 In March 1996, Vanstone Mill Inc. submitted an application for Site Plan Approval.
A 140 sq.m. (1500 sq.ft) pub is proposed in the basement of the Mill, seven
apartment units will occupy the second and third floors.

2.1 The negotiations for the Mill's site plan application were dependent on the
progress of approvals for the Seniors' Activity Centre. Issues such as traffic
circulation on site, grading and drainage were examined for both uses. The
details for the Seniors' Centre have been resolved and approval was granted by
Committee on June 17, 1996. There are, however a few outstanding items that
remain with the Mill site. Staff are confident that these issues can be resolved and
execution of a Site Plan Agreement will be imminent.
2.2 Under normal circumstances Staff do not recommend removal of a Holding (H)
Symbol until a Site Plan Agreement has been executed between the Municipality
and the developer, however, the pub tenant is anxious to obtain a building permit
and wishes to begin construction immediately, to take advantage of summer
business. Given Council's summer recess, there will not be an opportunity to
bring a by -law forward prior to September and consequently the permit cannot
be issued until the fall.
Staff wish to assist the tenant by issuing the permit in a timely manner. Staff will
issue a building permit for only the pub after the Site Plan Agreement is executed
but, will not grant occupancy until the conditions of both the Ministry of Natural
Resources and Central Lake Ontario Conservation Authority are fulfilled and both
agencies are satisfied with the works.
3. CONCLUSIONS
3.1 The removal of the Holding (H) symbol at this time will facilitate the renovations
for the pub. Staff will ensure that all of the appropriate conditions are met prior to
occupancy of the structure. As such, Staff respectfully recommend that the
removal of the Holding Symbol on the east side of Vanstone Mill Inc.'s lands.

BY -LAW 96-
being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law for the former
Town of Newcastle.
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows;
1. Schedule "3" to By -law 84 -63, as amended, is hereby further amended by
changing the zoning from;
"Holding - General Commercial Exception ((H)C1 -12) Zone "to "General Commercial
Exception (C1 -12) Zone"
2. Schedule "A" attached hereto shall form part of this By -law.
3. This By -law shall come into effect on the date passing hereof, subject to the
provisions of Section 36 of the Planning Act,
