THAT Report PD- 104 -96 be received; 2. THAT rezoning application DEV 89 -038 submitted by D. G. Biddle and Associates Ltd. on behalf of Kiddicorp Investments Inc. requesting the removal of the "Holding (H)" symbol from the subject lands be APPROVED; 3. THAT the amending By -law attached hereto be forwarded to Council for approval; 4. THAT a copy of this report and the amending by -law be forwarded to the Region of Durham Planning Department; and 5. THAT the interested parties in this report and any delegations be advised of Council's decision. 1. 1.1 1.2 1.3 APPLICATION DETAILS Applicant: Kiddicorp Investments Inc. Agent: Rezoning 1.4 Subdivision: D. G. Biddle and Associated Limited Removal of "Holding (H)" provision. to create 13, semi - detached /link lots, 26 units. 5%J r ' REPORT NO. PD- 104 -96 PAGE 2 2. LOCATION 2.1 The subject lands are located north of George Reynolds Drive and west of Trulls Road are further described as being in Part Lot 31, Concession 3, former Township of Darlington. 3. BACKGROUND 3.1 In April of 1996 Council considered and recommended draft approval of an application for draft plan of subdivision. On June 10, 1996, the Region of Durham granted draft approval to the subject lands to permit the development of 13 semi- detached /link lots, total of 26 units, subject to a number of conditions. The Municipality is currently drafting a subdivision agreement in consideration of the conditions of draft approval for the 26 unit development. 4. COMMENTS 4.1 The subject property is presently zoned "Holding -Urban Residential Type One ((H)R1) ". The subject development, 26 units, would comply with the provisions of the zone, subject to the removal of the Holding (H) symbol. The "Holding" symbol can be removed upon Council being satisfied that the uses to be permitted will be adequately serviced, have adequate access and will be used for the purposes intended by the By -law. 4.2 As noted previously, the Municipality is currently preparing a subdivision agreement which would address the proponents responsibility, financial and otherwise, with respect to development of these lands. The agreement is expected to be complete during Council's recess, hence the by -law is being forwarded at this time. 4.3 Pursuant to Section 35 of the Planning Act, a by -law amendment to remove the "Holding (H)" symbol is not subject to the normal appeal period afforded to a 576 REPORT NO. PD- 104 -96 PAGE 3 standard rezoning application. Accordingly the by -law shall be deemed to be final and binding once Council has granted approval of the by -law. 5. RECOMMENDATIONS 5.1 In consideration of the comments noted above, staff would have no objection to the removal of the "Holding (H)" symbol as shown on the attached by -law and schedule. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle in accordance with application DEV 89 -038. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule "4" to By -law 84 -63, as amended, is hereby further amended by changing the zone category from: "Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type One (Ri) ", as indicated on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By -law. 3. THAT this By -law shall come into effect on the date of the passing thereof, subject to the provisions of Section 36 of the Planning Act. BY -LAW read a first time this day of 1996.
