Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 100 -96 be received; 2. THAT Rezoning Application DEV 96 -031 submitted by G. D. Coggan on behalf of B. Ritchie and N. Keil requesting removal of the "Holding (H)" symbol from the subject lands be approved; 3. THAT the amending By -law attached hereto be forwarded to Council for approval; 4. THAT a copy of this report and the amending by -law be forwarded to the Region of Durham Planning Department; and 5. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. 1.1 1.2 1.3 APPLICATION DETAILS Applicant: Brian Ritchie & Norman Keil Agent: Rezoning 1.4 Land Severance: G. D. Coggan Removal of "Holding (H)" provision lands to be added to expand two existing industrial operations. - 5,'15- 0 REPORT NO. PD- 100 -96 PAGE 2 2. BACKGROUND 2.1 In May of 1996, an application was received by the Municipality of Clarington Planning and Development Department requesting removal of the "Holding (H)" provision from the lands associated with two land severance applications LD 109/96 and LD 110/96. The subject land is located on the west side of Bennett Road, south of the Highway 401. They are further described as being located in Part Lot 5, Broken Front Concession, Former Township of Darlington. 2.2 The two land severance applications are scheduled to be heard July 15, 1996. Staff are concurrently preparing comments for this meeting date and do not foresee any objections to the application subject to conditions. The first application proposes to sever 3.5 ha from a 21 ha parcel and meld it with the abutting industrial lands to the east. The second application divides the 3.5 ha into a 1.4 and 2.14 ha consistent with the existing lot line between the two existing industries, 314 and 322 Bennett Road. 3. COMMENTS 3.1 The subject property is presently zoned "Holding -Light Industrial ((H)M1). The "Holding " symbol can be removed upon Council being satisfied that the uses to be permitted will be adequately serviced, have adequate access, and will be used for the purposes intended by the By -law. 3.2 In response to the Town's circulation for comments pertaining to said application; Regional Planning and Regional Public Works have verbally advised they have no objection subject to conditions to be implemented through the severance applications. Similarly the Clarington Public Works have advised that a contribution towards C.N.R. tunnel works for the storm water management works will be payable as a condition of the land severance applications. This will amount to approximately $18,260.00. - 551 REPORT NO. PD- 100 -96 PAGE 3 3.3 Pursuant to Section 36 of the Planning Act, a By -law Amendment to remove the "Holding (H)" symbol is not subject to the normal appeal period afforded to a standard rezoning application, and accordingly shall be deemed final and binding should Council grant approval of same. 4. RECOMMENDATION 4.1 In consideration of the comments noted above, Staff would have no objection to the removal of the "Holding (H)" symbol as shown on the attached by -law and schedule.
