Subject: DISPOSITION OF THE SCHICKEDANZ APPLICATIONS FILES: OPA 89 -057/N AND DEV 89 -080 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -95 -96 be received; 2. THAT official plan amendment application OPA 89 -057/N and rezoning application DEV 89 -080 be closed; and 3. THAT the applicant Mr. Michael Hackenberger and Mr. Martin Mostert be advised of Council's decision. 1. BACKGROUND: 1.1 Report PD -55 -96 contained 102 recommendations on 101 applications and of these recommendations, 101 were approved by Council on April 29, 1996 through Resolutions #C- 358 -96 and #C- 359 -96. Recommendation #36 (for OPA 89- 057/N, Schickedanz Brothers) was the one exception. In regards to this recommendation, Resolution #C- 358 -96 stated: "THAT Recommendation #36 contained in Appendix 1 (OPA 89- 057/N, Schickedanz Brothers), be tabled to allow for the Chief Administrative Officer or appropriate staff to meet with all interested parties to resolve the outstanding concerns." 1.2 In regards to the Schickedanz applications, two delegations appeared before Council on April 29, 1996. Mr. Michael Hackenberger of the Bowmanville Zoo and ...2 599010 REPORT PD-95-96 PAGE 2 Mr. Richard Mostert of Mostert's Greenhouses both spoke of the concerns they had with the Schickedanz properties being developed. Mr. Hackenberger asked the Municipality to encourage dialogue between the zoo and Schickedanz Brothers. 2. COMMENTS: 2.1 On Wednesday May 29, 1996, Planning staff and Mr. Bob Schickedanz and his planning consultant - Mr. Gary Templeton, Mr. Michael Hackenberger, Mr. Martin Mostert and Mr. Richard Mostert met to discuss the subject matter. 2.2 Planning staff pointed out to Mr. Hackenberger and the Mosterts that OPA 89- 057/N was made in 1989 to request Durham Region to include the property north of Highway No. 2, between the zoo and Lambs Road, in an Urban Residential designation (see Attachment No. 1). This was subsequently achieved and the Schickedanz properties is shown as Living Area in the 1991 Durham Regional Official Plan. To reflect the Durham Plan designation, the Clarington Official Plan designates the property "Residential ". As a result, application OPA 89 -057/N is redundant and the file should be closed. 2.3 Mr. Hackenberger and Mr. Mostert indicated that they are not objecting to the principle of developing the Schickedanz properties. However, they have specific concerns associated with the details of development of the properties. Planning staff informed all present that a Plan of Subdivision application had never been filed and that when one is filed a related rezoning application will also have to be filed. Therefore, some of the concerns that were raised cannot be addressed at this time until details of the proposed development are made available. 2.4 Mr. Hackenberger asked Mr. Schickedanz what the timeframe would be for the development of his properties. Mr. Schickedanz estimated it would be approximately eight (8) years before shovels would be going into the ground. ...3 599011 REPORT However, he may submit a subdivision application in a couple of years to commence the planning process. 2.5 Mr. Schickedanz agreed to consult with Mr. Hackenberger and Mr. Mostert prior to designing his plan of subdivision. Planning staff urged Mr. Schickedanz to consider all the comments and concerns raised. 2.6 The meeting was considered productive and helpful by all parties. Communication between the parties is now established and staff is confident that the parties will maintain a positive attitude in open dialogue and work towards solutions. As discussed during our meeting we understand the concerns you have raised regarding the development of our property which is adjacent to the Bowmanville Zoo. In order to get a better appreciation of your concerns and the operation of the Zoo we will arrange a site visit with you within the next two months. The purpose of this visit will be to gather the necessary information in order to make our residential subdivision as compatible as possible with the Bowmanville Zoo.
