Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD -77 -96 be received;
2. THAT the zoning amendment application submitted by Schleiss and Holland
requesting the removal of the Holding (H) symbol from the subject lands within
part of Lot 34, Concession 3, former Township of Darlington be APPROVED;
3. THAT the attached by -law be forwarded to Council for approval; and
4. THAT all interested parties listed in this report and any delegation be advised of
Council's decision.
1. BACKGROUND
1.1 The draft approved plan of subdivision 18T -86068 is located in part of Lot 31,
Concession 3, in the former Township of Darlington. The applicant has applied
for the removal of the Holding (H) symbol which will eventually facilitate the
issuance of building permits following the registration of the final phase of plan
of subdivision 18T- 86068, which consists of 5 residential lots.

2. COMMENTS
2.1 Staff advise that the Holding (H) symbol may be removed upon Council being
satisfied that the uses to be permitted will be adequately serviced, have adequate
access and will be used for purposes intended by By -law 84 -63. In reviewing the
proposal, staff are satisfied that the conditions required for the removal of the
Holding (H) symbol have been met.
2.2 In consideration of the comments noted above, staff would have no objection to
the removal of the Holding (H) symbol as shown on the attached By -law and
schedule.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY -LAW NUMBER 96-
being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law for the former
Town of Newcastle.
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Schedule "4" to By -law 84 -63 as amended, is hereby further amended by changing the
zone designation from:
"Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type One (R1)"
2. Schedule "A" attached hereto shall form part of this By -law.
3. This By -law shall come into effect on the date of the passing hereof, subject to the
provisions of Section 36 of the Planning Act.
