The Corporation of the Municipality of Clarington
By-law 2023-067
Being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for The
Corporation of the Municipality of Clarington and to lift the Holding "H" provisions on
lands located within Phase 1 B of the Foster Northwest Subdivision.
Whereas the Director of Planning & Infrastructure Services of The Corporation of the
Municipality of Clarington is satisfied that the conditions for removing the holding symbol
on the subject lands have been satisfied.
A request has been made to remove "((H) R2-71) and ((H) R2-72)" Holding
Symbol on the subject lands.
2. Under the authority granted by the Province of Ontario through the Municipal Act,
2001, S.O. 2001, c.25 and the Planning Act, R.S.O. 1990, c. P.13, Municipal
Council has delegated to the Director of Planning & Infrastructure Services, with
the passing of By-law 2001-072, and amended by By-law 2023-014, the authority
to approve applications to remove holding symbols and pass related by-laws
pursuant to s.34 of the Planning Act.
Now therefore, be it enacted, and it is hereby enacted as a by-law of The Corporation of
the Municipality of Clarington as follows:
3. Schedule " Y to By-law 84-63, as amended, is hereby further amended by
changing the zone from:
"Holding — Urban Residential Type Two Exception (H)(R2-71) Zone" to "Urban
Residential Type Two Exception (R2-71) Zone"; and
"Holding — Urban Residential Type Two Exception (H)(R2-72) Zone" to "Urban
Residential Type Two Exception (R2-72) Zone"
as illustrated on the attached Schedule "A" hereto.
4. Schedule "A" attached hereto shall form part of the By-law.
5. This By-law shall come into effect on the date of approval, subject to the provisions
of Sections 34 and 36 of the Planning Act.
