Report #: PD -63 -96 File #: DEV 96 -014 (X -REF: 18T- 87087) By -law # Subject: REMOVAL OF HOLDING SYMBOL APPLICANT: HALLOWAY HOLDINGS PART LOT 12, CONCESSION 2, FORMER TOWN OF BOWMANVILLE FILE: DEV 96 -014 ( X -REF: 18T- 87087) Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -63 -96 be received; 2. THAT the zoning amendment application submitted by Halloway Holdings requesting the removal of the Holding (H) symbol from the subject lands within Part of Lot 12, Concession 2, former Town of Bowmanville be APPROVED; 3. THAT the attached By -law be forwarded to Council for approval; and 4. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. BACKGROUND 1.1 The draft plan of subdivision 18T -87087 is located in Part of Lot 12, Concession 2, in the former Town of Bowmanville. Said Subdivision was approved by Council and draft approved by the Region of Durham. The applicant has now applied for the removal of the Holding (H) symbol in order to proceed with the registration of Phase 1 of the subdivision. 1.2 For the Committee's information, since the lots are located in a draft approved plan of subdivision, there will be agreements in place to cover the Municipality's financial interest including the parkland dedication and the payment of development charges. 543 ...2 REPORT NO. STAFF COMMENTS 2.1 Staff advise for the Committee's information that the Holding (H) symbol may be removed upon Council being satisfied that the uses to be permitted will be adequately serviced, have adequate access and will be used for the purposes intended by By -law 84 -63. In reviewing the proposal, staff are satisfied that the conditions required for the removal of the Holding (H) symbol have been met. 2.2 In consideration of the comments noted above, staff would have no objection to the removal of the Holding (H) symbol as shown on the attached By -law and schedule. Floor Oshawa, Ontario U G 3S2 544 545 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY -LAW NUMBER 96- being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law for the former Town of Newcastle. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule "3" to By -law 84 -63 as amended, is hereby further amended by changing the zone designation from: "Holding - Urban Residential Type One ((H)Rl)" to "Urban Residential Type One (111) "; "Holding - Urban Residential Type Two ((H)R2)" to "Urban Residential Type Two (112) "; "Holding - Urban Residential Type Three ((H)R3)" to "Urban Residential Type Three (R3)" 2. Schedule "A" attached hereto shall form part of this By -law. 3. This By -law shall come into effect on the date of the passing hereof, subject to the provisions of Section 36 of the Planning Act.
