THAT Report PD -44 -97 be received; 2. THAT the proposed Plan of Subdivision 18T -89070 revised and dated October 22, 1996, as per Attachment No. 3 be APPROVED subject to the conditions contained in this Report; 3. THAT the Mayor and Clerk be authorized by By -law, to execute a Subdivision Agreement between the Owner and the Municipality of Clarington at such time as the Agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning; 4. THAT the application to amend the former Town of Newcastle Comprehensive Zoning By -law 84 -63, as amended, be APPROVED and the "Holding (H)" symbol be removed by By -law at such time as the Subdivision Agreement has been finalized to the satisfaction of the Director of Public Works and Director of Planning and Development; and 5. THAT a copy of the Report and Council's decision be forwarded to the Region of Durham Planning Department; and 6. THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: G.M. Sernas and Associates 1.2 Owner: Donald Prins in Trust 1.3 Rezoning: From - Agricultural (A) and Holding Urban Residential Type One - (H) R1 To - zones appropriate to permit the development of a residential subdivision cone 'Tipg a mix of housing types J 1.4 Subdivision: seeking approval of a Plan of Subdivision for a total of 78 units comprised of 36 semi - detached dwellings, and a medium density block having 42 units. There are 8 blocks which will generate 8 single detached lots when the abutting lands develop. 1.5 Area: 3.18 ha • • 2.1 The subject lands are located in part of Lot 11 Concession 2 former Town of Bowmanville. The parcel is located on the west side of Liberty Street North, between Longworth and Freeland Avenues. 3. BACKGROUND 3.1 The original applications for Rezoning and Plan of Subdivision were received on July 27th, 1989 proposing a mix of housing types for a total of 61 residential units. The plan has been revised a number of times with unit counts reaching 109 units. It was not until October 1996, that a revised subdivision plan was submitted for the Municipality's review. 4. EXISTING AND SURROUNDING USES 4.1 Existing Uses: Vacant 4.2 Surrounding Uses: East - Draft Approved Plan of Subdivision 18T -89041 West - Draft Approved Plan of Subdivision 18T -87021 South - Draft Approved Plan of Subdivision 18T -82037 North - Draft Approved Plan of Subdivision 18T -87021 646 REPORT PD -44 -97 PAGE 3 5. OFFICIAL PLAN POLICIES 5.1 The Durham Region Official Plan designates the subject lands "Living Area ". The predominant use of lands shall be residential providing a mix of housing types and densities. In that this is a residential application and that a range of housing types and densities are provided in the neighbourhood, this application is deemed to conform to the Durham Region Official Plan. 5.2 The Clarington Official Plan designates the easterly portion of the subdivision as "Local Central Area" and the westerly portion as "Low Density - Urban Residential ". Lands designated "Low Density - Urban Residential" shall be used for housing purposes at a density not to exceed 30 units per net hectare. The lands subject to the "Low Density" designation have stayed within this density parameter. As for the lands located within the Local Central Area, the Official Plan allocates 50 medium density units as allowable in the Local Central Area. These units are shown in Block 17 (42 units) and Block 217 (6 units) on the abutting Draft Approved Plan of Subdivision 18T- 87021. The proposed medium density development conforms to the Official Plan. 6. ZONING BY -LAW PROVISIONS 6.1 The subject lands are zoned "Agricultural (A)" and "Holding -Urban Residential Type One (H) R1 ". The Agricultural zone permits farms and farm related uses. The "Holding -Urban Residential Type One" zone allows for the development of single and semi - detached dwelling units. In order to permit this proposed plan of subdivision, the lands require rezoning. Staff are proposing that the lands be zoned "Holding Urban Residential Type One [(H)R1]" and "Holding Urban Residential Type Three [(H)R3]. The semi - detached dwellings and the blocks for single detached dwellings will be zoned "(H)R1 ". The medium density block will be zoned "(H)R3 ". The Holding (H) symbol may not be removed until the 647 REPORT PD -44 -97 PAGE 4 subdivision agreement is finalized and all concerns, financial or otherwise, are satisfied. • 7.1 Pursuant to Council's Resolution of July 26, 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 7.2 The first public meeting was held on December 4, 1989, addressing the original application. Upon the submission of a revised plan, increasing the number of units to 109 and increasing the land area, a second public meeting was held on July 9, 1990. It was at this public meeting that the lands identified as Block 217 on Plan 18T- 87021, were included within the lands described as 18T- 89070. At that time, there was one owner of 18T -89070 & 18T -87021 being Reemark. 7.3 Authorization from the landowner to the north (Quadrillium) has been given to change the zoning of Block 217 in Plan 18T -87021 from "Holding -Urban Residential Type One ((H) R1)" to "Holding -Urban Residential Type Three ((H) R3) ". This will enable the Block to develop in conjunction with Block 17, (Medium Density Block) on plan 18T- 89070. (Attachment #5) 7.4 There have been no citizen comments or concerns noted at either of the Public meetings or at any other time. 8. AGENCY COMMENTS 8.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following departments /agencies in providing comments, offered no objection to the application as filed: 648 Municipality of Clarington Community Services Municipality of Clarington Fire Department Clarington Hydro Electric Commission PAG E 5 8.2 Comments were received from the Municipality of Clarington Public Works Department. They stated that the proposed draft plan could not proceed to registration until the internal roadworks and services in the adjacent plans of subdivision 18T -87021 and 18T -82037 have been completed. These lands represent the divide between the Soper Creek Watershed and the Bowmanville Creek Watershed. The applicant is responsible for his share of the cost of downstream stormwater works for the Northwest Bowmanville watershed. The subdivision agreement shall incorporate the appropriate clauses addressing the timing and amount of the future front end payment. With respect to the Soper Creek Watershed, no agreements were registered against title to these lands. Hence, the Municipality is not required to collect monies to reimburse downstream developers for any work. Public Works also noted that when the Medium Density Block (Block 17) develops the cost of providing entrance illumination onto Liberty Street will be fully the responsibility of the developer. With respect to parks, the Works Department requests that parkland dedication be received at the rate of 5% cash -in -lieu of parkland. Other Works requirements are itemized within the Conditions of Approval which are included as Attachment #1 to this report. 8.3 Comments received from the Central Lake Ontario Conservation state that these lands are subject to approved Stormwater Drainage Plans. They also stated that the western half of the lands have not been included in the first phase of the Implementation Plan for the Bowmanville Creek Stormwater Plan. As such, CLOC has no objections provided that conditions are incorporated addressing stormwater management. These conditions are detailed in the Attachment #1 - Conditions of Approval. REPORT PD -44 -97 PAGE 6 8.4 The Northumberland Clarington Board of Education note that the nearest existing elementary school is presently over capacity. As such, they have asked that this development be phased in accordance with the availability of satisfactory school accommodation. They also request that sidewalks be built on the internal roads and on the west side of Liberty Street. Staff note that the Clarington Official Plan shows that an elementary school will be sited to the west of this application. West of these lands is Plan of Subdivision (18T- 87087) which is draft approved having a block reserved for school purposes. 8.5 The Peterborough Victoria Northumberland and Clarington Roman Catholic Separate School Board noted that within the Clarington Official Plan, a separate elementary school site is situated within the vicinity of these lands. They requested that sidewalks be constructed within this subdivision. 8.6 Durham Region Works stated that water services are available for the western portion of the lands from Liberty Street. The remainder of the site shall be serviced including sanitary sewer, from the adjoining southerly lands. They requested that the road widening block (Block 26) be conveyed to the Region and that a 0.3 metre reserve along Liberty Street also be conveyed to the Region (Block 27). 9. STAFF COMMENTS 9.1 The application provides a mix of housing, having 42 medium density units (townhouses), 36 semi - detached units, and 8 blocks for single detached units. 9.2 Staff are satisfied that the density of the development is within the range permitted within the Official Plan and that the application proposes a mix of housing types which is also in keeping with the Official Plan. 9.3 The Regional Works department requested that a 0.3 metre reserve be conveyed to them along the Liberty Street frontage. The plan shows Block 27 being the 0.3 6:F _')0 REPORT PD -44 -97 PAG E 7 metre reserve block falling short of the north property line. Staff have red -lined revised Block 27, extending it across the entire Liberty Street frontage. 9.4 Staff note that although the Region did not request a 5 m+ road widening along the entire Liberty Street frontage, we anticipate that the Region will make this a requirement of draft approval. 9.5 A noise report was prepared sometime ago for this application. However, minor changes are required in this report ensuring that references to blocks and lot numbers are consistent with the October 22, 1996 revised plan of subdivision. 10. CONCLUSION 10.1 Staff respectfully recommend that the proposed plan of subdivision as per Attachment #3 Red -lined revised Plan of Subdivision be recommended for draft approval subject to the conditions contained in this Report and that the attached by -law be adopted by Council. That this approval applies to draft Plan of Subdivision 18T -89070 prepared by G.M.Sernas and Associates Ltd. dated October 22, 1996 (and further revised in red as per the attached plan) showing Lots 1 to 14 inclusive for semi - detached or linked dwellings, Block 17 as a Medium Density Block for 42 units, Blocks 18 - 25 as Part Lots for Single Detached Dwellings to be reserved by the owner, 4 red- lined revised semi - detached lots and various blocks for reserves and road widenings. FINAL PLAN REQUIREMENTS 2. That all streets within the Plan of Subdivision shall be dedicated as public highway and shown as such on the final plan. 3. That all streets shall be named to the satisfaction of the Municipality of Clarington and shown on the final plan. REQUIREMENTS TO BE SATISFIED PRIOR TO SUBDIVISION AGREEMENT 4. That the Owner shall retain a professional engineer to prepare and submit a Master Drainage and Lot Grading Plan to the Director of Public Works for review and approval. All plans and drawings must conform to the Municipality's Design Criteria as amended from time to time. 5. That the draft plan not be registered until the Director of Public Works is satisfied with the completion of external road works and services within the abutting plans of subdivision being 18T -82037 and 18T- 87021. REQUIREMENTS TO BE INCLUDED IN SUBDIVISION AGREEMENT 6. That the Owner shall enter into a Subdivision Agreement with the Municipality and agree to abide by all terms and conditions of the Municipality's standard subdivision agreement, including, but not limited to, the requirements that follow. 53 CONDITIONS OF APPROVAL OF FINAL PLAN REGISTRATION 7. That all easements, road widening, and reserves as required by the Municipality shall be granted to the Municipality free and clear of all encumbrances. 8. That the Owner shall pay to the Municipality at the time of execution of the subdivision agreement, five percent (5 %) cash -in -lieu of parkland dedication for residential development. 9. That the Owner shall pay to the Municipality, the development charge in accordance to the Development Charge By -law as amended from time to time, as well as payment of a portion of front end charges pursuant to the Development Charge Act if any are required to be paid by the owner. 10. That the owner reimburse the downstream front ending developers for an appropriate share of the cost of the works for the oversizing of downstream stormwater works in the Northwest Bowmanville watershed area. The agreement shall contain appropriate clauses providing for the timing and amount of the future front end payment. Any required front end payments shall be determined in accordance with the provisions of the Development Charges legislation, shall be included in the development agreement for these lands and shall be to the satisfaction of the Municipality's solicitor and the Director of Public Works. 11. That the storm water drainage works and facilities necessary for the western portion of this development be constructed in accordance with the Northwest Bowmanville Master Drainage Study, prepared by G.M. Sernas and Associates and as finally approved by the Director of Public Works. 12. That the owner construct all drainage works within the western portion of this draft plan in accordance with the Northwest Bowmanville Stormwater Management Implementation Report. 654 CONDITIONS OF APPROVAL OF FINAL PLAN REGISTRATION 13. That the owner's engineer prepare a Master Grading and Drainage Plan that details the configuration of the on -site storm sewer system (minor system) and the conveyance of the overland flow (major system) from this subdivision. 14. That the stormwater management facilities be designed and implemented in accordance with the Master Drainage Plan for the West Branch of Soper Creek. 15. That the Owner shall provide and install sidewalks, street lights, temporary turning circles etc. as per the Municipality's standards and criteria. 16. That Block 17 in Plan of Subdivision 18T -89070 and Block 217 in Plan of Subdivision 18T -87021 shall be planned in a comprehensive fashion and that the two blocks be developed in accordance with a site plan agreement entered into by both land owners. 17. Through site plan approval, the owner of Block 17 shall be responsible for 100% of the cost of entrance illumination for any future entrances onto Regional Road M 18. That the Owner shall cause all utilities, including, hydro, telephone, Cable TV, etc. to be buried underground. 19. That the Owner shall provide the Municipality, at the time of execution of the subdivision agreement unconditional and irrevocable, Letters of Credit acceptable to the Municipality's Treasurer, with respect to Performance Guarantee, Maintenance Guarantee, Occupancy Deposit and other guarantees or deposit as may be required by the Municipality. 20. That the Owner shall adhere to architectural control requirements of the Municipality. 655 CONDITIONS OF APPROVAL OF FINAL PLAN REGISTRATION 21. That the Owner prepare a noise report to the satisfaction of the Municipality and the Region.That prior to the issuance of building permits, the Owner shall, through its acoustic engineer, provide a certification to the Director of Planning, certifying that the Builder's plans are in accordance with the Noise Control Report as approved by the Region of Durham and the Municipality of Clarington. 22. That prior to the issuance of building permits, access routes to the subdivision must be provided to meet Subsection 3.2.5.2(6) of the Ontario Building Code and, that all watermains and hydrants are fully serviced and the Owner agrees that during construction, fire access routes be maintained according to Subsection 2.5.1.2 of the Ontario Fire Code, storage of combustible waste be maintained as per Subsection 2.4.1.1 and open burning as per Subsection 2.6.3.4 of the Ontario Fire Code. 23. That the Owner shall satisfy the requirements of the Northumberland - Clarington board of Education and the Peterborough Victoria Northumberland and Clarington Roman Catholic Separate School Board. AND WHEREAS, the Council of the Corporation of the Municipality of Clarington recommends to the Region of Durham for approval of draft Plan of Subdivision 18T- 89070; and, AND WHEREAS, the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the Corporation of the Municipality of Clarington to implement the draft Plan of Subdivision; NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Clarington enacts as follows: 1. Schedule "3" to By -law 84 -63, as amended, is hereby further amended by changing the zone designation from: "Agricultural (A)" to "Holding - "Urban Residential Type Three ((H)R3) "; "Agricultural (A)" to "Holding - "Urban Residential Type One ((H)R1) "; "Holding -Urban Residential Type One ((H)R1)" to "Holding -Urban Residential Type Three ((H)R3) ". as shown on the attached Schedule "A" hereto. 2.
