Preliminary Note
This Committee of Adjustment meeting took place in a ‘hybrid’ format. Members listed as
being “electronically present,” as well as applicants and members of the public,
participated though the teleconferencing platform Microsoft Teams, which allows
participation through a computer’s video and audio, or by telephone.

1. Call to Order
The Chair called the meeting to order at 7:00 p.m.
2. Disclosures of Pecuniary Interest
There were no pecuniary interests stated for this meeting.
3. Adoption of Minutes of Previous Meeting, July 27thh, 2023
The Committee agreed to move the approval of the meeting minutes
for July 27th 2023 to the next Committee meeting.

4. Application: A minor variance application to permit additional uses to the
existing “Agricultural-Exception (A-36) zone” to allow outdoor storage,
outdoor repair, and selling of utility vehicles, golf carts, and trailers, be
tabled for up to 6 months to allow for further discussions and to acquire
more information from the applicant to fully understand their business
proposal that seeks for additional uses to the “Agricultural- Exception (A-
36) zone”.
4.1 A2023-0025 Owner: Mark Ollerenshaw and Joe Labriola
Applicant: Michael Fry

M Ollerenshaw, one of the two applicants, in person in Council Chambers, gave a verbal
presentation to the Committee regarding the application.
M Fry, the Planner on file, in person at Council Chambers, provided comments to the
Committee regarding the application.
D Eastman asked – Mr. Chair, I would just like to clarify something with the applicant.
Which area is going to be used for storage? The fencing area?
M Ollerenshaw responded – The proposal is to sell vehicles off the property and are hoping
to be able to sell utility trailers. The land is bare grass and there is a small podium that will
be used for storage. The lands to the west are not to be used for storage and that includes
the fencing area.
D Eastman asked- Are you planning to expand the outside area for storage?
M Ollerenshaw responded- Yes that is correct.
T Taylor asked if there were any questions regarding the application from members of the
public.
No other Committee Members had questions or comments.
No member of the public spoke in support of or in opposition to the application.
Motion to approve A2023-0025 as recommended by D Eastman, seconded by G
Wallace.

Full text of Decision: To approve Minor Variance Application A2023-0025 to permit the
use additional uses to the existing “Agricultural- Exception (A-36) zone” to allow outdoor
storage, outdoor repair, and selling of utility vehicles, golf carts, and trailers.
“That the application A2023-0023, for Minor Variances to Section 3.1.c of Zoning By-law
84-63 to facilitate the construction of an accessory building by increasing the maximum
total accessory floor area from 90 square metres to 200 square metres and increasing the
maximum height from 4.5 metres to 6.2 metres be approved, as it is minor in nature,
desirable for the appropriate development or use of the land and maintains the general
intent and purpose of the Zoning By-law, the Durham Region Official Plan and Clarington
Official Plan”.

Application: A minor variance application to permit an apartment building as an
additional permitted use to facilitate a four-unit apartment building within an Urban
Residential – Type One (R1) zone.
4.2 A2023-0026 Owner: Brayden Libawski
Applicant: Brayden Libawski
79 Queen Street, Part Lot 12, Concession 1, Former
Township of Bowmanville
B Libawski, the applicant, who was not in Council chambers, did not attend the meeting
and there was no verbal presentation to the Committee regarding the application.
T Taylor asked if there were any questions from Committee members regarding the
application.
T Taylor asked if there are any questions from the public regarding the application
D Clark (neighbour to 79 Queen Street) asked a question to the Committee- Is it legal or
not legal?
M Jones responded – The purpose of the application was to legalize the three units (4
units total) and if the minor variance application was granted, then there would be four
units that would become legal if that happens.
D Clark asked Morgan – Why is there four units there now?
M Jones responded – I am not sure, but that would be a better question for the applicant.
D Clark responded – The property is not maintained and is a mess, so I am very much
concerned about this.

T Tayor asked if there are any other questions from the public.
M Hutchinson (neighbour to 79 Queen Street) made a comment to the Committee- Since
it has developed into apartments, the property has gone downhill and has not been
maintained. I would like to make that clear to the Committee and to make sure that the
Committee takes note of that.
T Taylor asked if there were any questions regarding the application from the committee
members or members of the public.
No other Committee Members had questions or comments.
Motion for Minor Variance Application A2023-0026 to be tabled for up to 6 months as
recommended by G Wallace, seconded by D Eastman.

“That application A2023-0026 to be tabled for up to 6 months to allow the applicant and
staff to have further discussions and to acquire more information from the applicant to
fully understand the business proposal for three additional apartment units within an
Urban Residential (R1) zone.”

Application: A minor variance application to permit an existing accessory structure (pool
deck) by increasing the rear yard and interior side yard setbacks for accessory
structures from 0.6m to 0.3m. Additionally, to permit an existing raised concrete
patio by increasing the maximum lot coverage from 45% to 57%.

A Parsons, the homeowner and applicant, in person in Council Chambers, gave a verbal
presentation to the Committee regarding the application.
A Parsons asked- We have sent an email to the Committee. Did the Committee receive
it?
T Taylor – I do not think we received an email.
A Parsons – No problem, I will follow up and resend it.
T Taylor asked if there were any questions regarding the application from the committee
members or members of the public.

Motion to approve A2023-0028 as recommended by D Eastman, seconded by G
Wallace.

“To approve Minor Variance Application A2023-0025 to permit an existing accessory
structure (pool deck) by decreasing the rear yard and interior side yard setbacks for
accessory structures from 0.6m to 0.3m, and to approve to permit an existing raised
concrete patio by increasing the maximum lot coverage from 45% to 57%.”

Motion to approve A2023-0029 as recommended by G Wallace, seconded by D
Eastman.

“To approve Minor Variance Application A2023-0029 to permit the construction of an
accessory structure (deck) and pavilion by increasing the maximum total accessory floor
area from 60 to 90 square metres and increasing the maximum allowable height of an
accessory structure from 4 metres to 5.3 metres.”

gave a verbal presentation to the Committee regarding the application.

members or members of the public.
No other Committee Members or the public had questions or comments.
Motion to approve A2023-0030 as recommended by D Eastman, seconded by G
Wallace.
Full text of Decision:
“To approve Minor Variance Application A2023-0030 to permit the construction of a below
grade stairwell to a dwelling by increasing the rear yard projection from 1.5 metres to 3.2
metres, leaving a 4.3 metres rear yard setback.
