LOT 6, BFC, FORMER TOWNSHIP OF DARLINGTON FILE: DEV 97 -038 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -97 -97 be received; 2. THAT the rezoning application submitted by Michael Gimblett on behalf of Schleiss Development Corporation Limited & 649101 Ontario Limited requesting the removal of the "Holding (H)" symbol from the subject lands be APPROVED; 3. THAT the amending By -law attached hereto be forwarded to Council for approval; 4. THAT a copy of this report and the amending By -law be forwarded to the Region Durham Planning Department; and, 5. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: Schleiss Development Corporation Ltd. & 649101 Ontario Ltd. 1.2 Agent: Michael Gimblett 1.3 Rezoning: Removal of "Holding (H)" symbol 1.4 Site Plan Application: To construct a 9,666 m2 ice sports facility comprised of two ice pads, restaurant, and pro shop. 1.5 Site Area: 7.72 hectares (19.1 acres) 699042 REPORT PD -97 -97 PAGE 2 2. BACKGROUND 2.1 On May 27, 1997, Michael Gimblett submitted applications on behalf of Schleiss Development Corporation Limited & 649101 Ontario Limited for site plan approval and removal the "Holding (H)" symbol. The subject lands are located at the southeast corner of Lambs Road and Highway 401 in Bowmanville. They are legally described as Part Lot 6, Broken Front Concession, in the former Township of Darlington. 2.2 The removal of the "Holding (H)" symbol would permit development of a new 9,666 m2 ice sports facility comprised of two ice pads, restaurant, and pro shop. The facility would be used for ice sports on a year round basis. An area west of the building has been reserved for two soccer fields. A copy of the proposed site plan is attached for information purposes. 3. STAFF COMMENTS 3.1 The lands are currently zoned "Holding - Light Industrial ((H)M1)" which permits the proposed development. The removal of the "Holding (H)" symbol is necessary in order to allow the development to proceed. Despite removal of "H" symbol development cannot proceed until a subdivision agreement and a site plan agreement has been executed to the satisfaction of the Municipality. 3.2 The site plan application has been circulated to the appropriate agencies and will be subject to various conditions of approval. 3.3 Pursuant to Section 36 of the Planning Act, a Zoning By -Law Amendment to remove the "Holding (H)" symbol is not subject to the normal appeal period applicable to standard rezoning applications, and therefore shall be deemed final and binding should Council grant its approval. 699043 REPORT PD -97 -97 4. RECOMMENDATION PAGE 3 4.1 In consideration of the comments noted above, Staff would have no objection to the removal of the "Holding (H)" symbol as shown on the attached By -law. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -Law 84 -63, as amended, of the Corporation of the former Town of Newcastle to implement application DEV 97 -038 to permit the construction of a 9,666 m2 ice sports facility comprised of two ice pads, restaurant, and pro shop. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule "1" to By -Law 84 -63, as amended, is hereby further amended by changing the zone designation from: "Holding - Light Industrial ((H)M1) Zone" to "Light Industrial (M1) Zone" as shown on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By -Law. 3. This By -Law shall come into effect on the date of the passing hereof, subject to the provisions of Section 36 of the Planning Act. By -Law read a first time this day of 1997. By -Law read a second time this day of 1997. By -Law read a third time and finally passed this day of 1997.
