PART LOTS 18,19 & 20, CONC. 1, FORMER TOWNSHIP OF CLARKE FILE NO.: ROPA 97 -012 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -96 -97 be received; 2. THAT the Region of Durham Planning Department be advised that the Municipality of Clarington has no objections to the Official Plan Amendment application as submitted by Imperial Oil Limited on behalf of Ministry of Transportation; 3. THAT a copy of this report by forwarded to the Durham Region Planning Department for consideration; and, 4. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. 1.1 1.2 1.3 APPLICATION DETAILS Applicant: Ministry of Transportation P.- Imperial Oil Limited Official Plan Amendment Application: To extend municipal sanitary services from the Newcastle Village sewage treatment plant to the site permitting a 19,300 sq.ft. commercial redevelopment project including three restaurants, gas station, and kiosk. 1.4 Site Area: 13.4 hectares (33.1 acres) 699036 REPORT NO. PD -96 -97 PAGE 2 • _► • 2.1 The subject lands are located on the north side of Highway 401 west of Newtonville Road. The applicant's land holdings total 13.4 hectares (33.1 ac). The property in legal terms is described as Part Lots 18, 19 & 20, Concession 1, in the former Township of Clarke. 3. BACKGROUND 3.1 On May 30, 1997, the Clarington Planning Department was circulated an application to amend the Durham Region Official Plan filed by Imperial Oil Limited on behalf of Ministry of Transportation. The purpose of the application is to extend municipal sanitary services from the Newcastle Village sewage treatment plant to the site to permit the commercial redevelopment of a 19,300 sq.ft. building containing three restaurants by Scott's Foods Limited. In addition, Imperial Oil Limited would redevelop the gas station and kiosk. The servicing extension would be privately funded by the proponent. 4. EXISTING AND SURROUNDING USES 4.1 Existing Uses: Restaurant and gas station 4.2 Surrounding Uses: East: Vacant land North: Vacant land West: Vacant land South: Vacant land 5. OFFICIAL PLAN POLICIES 5.1 Within the Durham Region Official Plan, the subject lands are not located within an area to be serviced by municipal sewage and water services. The Plan contains no provisions for the extension of municipal sanitary services beyond the urban areas. As a result, the applicant has applied to amend the policies to permit an extension of municipal sanitary services from Newcastle Village to the subject lands. 6990 i 7 REPORT NO. PD -96 -97 PAGE 3 5.2 The Clarington Official Plan does not contain policies for the extension of sanitary sewage services beyond urban areas. The allocation of sanitary sewage capacity is a Regional responsibility. Should this amendment by approved, the Clarington Official Plan would be deemed to be in conformity with the Durham Region Official Plan. 6. AGENCY COMMENTS 6.1 The application was circulated to solicit comments from other relevant agencies. The Clarington Fire Department has no objections to the application. 6.2 The Clarington Public Works - Engineering Division has indicated no objections to the proposal provided that all requirements relating to the site plan application are fulfilled. 7. STAFF COMMENTS 7.1 The existing development is serviced by private well and sewage tile bed and spray irrigation system. The applicant has investigate a number of servicing options for the development. • An expansion of the existing sewage tile bed and spray irrigation system was contemplated. A hydrogeological study indicated that the soils were not conducive based on the size of the tile bed required for this development. In order to accommodate the development, a 50 acre tile bed and spray irrigation system would be required at a cost of $750,000, excluding land acquisition costs. Land acquisition would be the responsibility of Imperial Oil. ® A system of sewage storage and haulage was investigated. Costs to operate such a system are estimated between $200,000 to $300,000 per year. Based on a 20 year lease agreement with the Ministry of 6 990:8 REPORT NO. PD -96 -97 PAGE 4 Transportation, the sewage disposal costs would range between $4 to $6 iii The final option would involve the extension of municipal sanitary services from the Newcastle Village sewage treatment plant to the site. The cost for this privately funded service extension is estimated between $1 to $1.25 million. A pipeline would be buried approximately 1.8 metres below the surface within the Highway 401 right -of -way. The total length of the facility is 4 km from Newcastle Village to the subject lands. 7.2 There are concerns that approval of the application could set a precedent whereby residents in adjacent hamlets could request a further extension of services. Staff do not feel that this could occur because this is a private venture, not a public one. A condition of approval should stipulate that the applicant not be permitted to further extend these services to adjacent hamlet areas. 7.3 From the discussion of the various servicing alternatives, the applicant favours the extension of municipal sanitary services from Newcastle Village for this development. Based on the comments provided in this report, Staff have no objection to the APPROVAL of the extension of municipal sanitary services from Newcastle Village to the subject lands.
