THAT Report PD -93 -97 be received; 2. THAT Council concur with the decisions of the Committee of Adjustment made on June 12, 1997; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decision of the Committee of Adjustment in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Municipality for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. 1.2 The Committee heard a total of four applications at the June 12, 1997 meeting. Three of the applications were approved as applied for, while application A97/037 was tabled to the next meeting to allow the applicant time to revise his proposal. ./2 6990 18 1 :1 • 1.3 A97/037 is an application to reduce the required 3 metre (1 Oft) sight triangle at the intersection of a private driveway and a municipal road. The applicant's property is a corner lot and he is proposing to construct a 1.8 metre (6.Oft) high wood privacy fence to enclose his rear yard. The fence encroaches into the sight triangle of both his driveway and his neighbour's driveway. Staff did not support the application as filed as it was felt the variance applied for would create a potential safety issue. 1.4 Staff have reviewed the Committee's decisions and are satisfied that the decision to approve the applications, is in conformity with the Official Plan policies, consistent with the intent of the Zoning By -law, is minor in nature and desirable. 1.5 Council's concurrence with the Committee of Adjustment decisions is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of any decision of the Committee of Adjustment.
