PART LOTS 15, CONCESSION 1, FORMER TOWN OF BOWMA�VILLE FILE NO.: DEV 97 -027 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -84 -97 be received; 2. THAT the application to amend the Comprehensive Zoning By -law 84 -63 of the former Town of Newcastle, submitted by The Kaitlin Group Limited for amendment be referred back to staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and K3 1. THAT Durham Region Planning Department and all interested parties listed in this report and any delegation be advised of Council's decision. APPLICATION DETAILS 1.1 Applicant: 1.2 Rezoning: 1.3 Area: The Kaitlin Group Limited "Agricultural (A)" to an appropriate zone to permit the development of five (5) residential lots for 10 linked dwelling units. 0.295 ha 601 REPORT NO.: PD-84-97 PAGE 2 2. LOCATION 2.1 The subject property is located in Part of Lot 15, Concession 1, in the former Town of Bowmanville, and fronts on Abernethy Crescent. 3. BACKGROUND 3.1 Application for rezoning was received by the Municipality's Planning Department on May 22, 1997. The subject parcel has been part of a 6.9 ha parcel which, historically was used for agricultural purposes, but presently is being used residentially, although the barn (c. 1920) is still exists on the lot. This parcel is surrounded now by residential development. 4. EXISTING AND SURROUNDING USES 4.1 Existing Uses: Single- detached dwelling and barn 4.2 Surrounding Uses: West - existing residential East - existing residential South - existing residential North - existing residential 5. OFFICIAL PLAN POLICIES 5.1 Within the Durham Region Official Plan the subject property is designated "Living Area ". Lands within this designation are to be used for housing purposes predominantly. The proposal would conform with this policy. 5.2 Within the Municipality of Clarington Official Plan the subject property is designated "Urban Residential" and "Environmental Protection Area ". The majority of the property is designated Urban Residential. The predominant use of lands within the Urban Residential designation shall be for housing purposes. The lands designated Environmental Protection Area are located at the rear of the proposed lots and would not permit any development. However, the extent of 602 REPORT NO.: PD -84 -97 PAGE 3 these Environmental Protection Areas with the local Official Plan are approximate only. The precise limits of these areas shall be detailed through the review of the application with the Central Lake Ontario Conservation. 6. ZONING BY-LAW .. 6.1 The site is currently zoned "Agricultural (A) ". This zone permits one single detached dwelling and buildings and structures accessory thereto per lot. The proposed residential uses are not currently permitted. 7. PUBLIC NOTICE AND SUBMISSIONS 7.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning act, the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner and tenant within the prescribed 120 metres (400 ft.) distance of the subject property. As of the date of the drafting of this report, one inquiry has been received regarding the proposed density of the development. 8. AGENCY COMMENTS 8.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following department /agencies in providing comments, offered no objection to the application as filed: Clarington Public Works Department and the Clarington Fire Department. 8.2 To date, comments remain outstanding from the Central Lake Ontario Conservation, Regional Planning Department, Regional Works Department, Ontario Hydro and Bell Canada. 6 H() REPORT NO.: PD -84 -97 PAGE 4 9. STAFF COMMENTS 9.1 The applicant is proposing to complete the development of Abernethy Crescent by rezoning the lands to permit residential uses. The 0.295 ha parcel will be divided through the land division process to create five (5) new lots, which will accommodate five sets of linked dwellings, for a total ten (10) homes. 9.2 Staff are awaiting Central Lake Ontario Conservation comments on this application to determine the extent and impact of the Environment Protection Area designation upon these proposed lots. 10. CONCLUSION 10.1 The purpose of this report is to facilitate the Public Meeting as required by the Planning Act, to provide Committee and Council with some background on the application submitted and for staff to indicate issues or areas of concern regarding the subject application. It is recommended the application be referred back to staff for further processing and subsequent report upon resolution of the above issues and receipt of all outstanding comments.
