THAT Report PD -74 -97 be received; 2. THAT Council concur with the decisions of the Committee of Adjustment made on May 8, 1997; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Municipality for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. All applications heard by the Committee were approved. 1.2 A97/008 was previously TABLED at a meeting on February 27, 1997. At that time the application included a reduction of three (3) parking spaces and a reduction of driveway aisle width from 6.0 metres (19.6 ft) to 3.88 metres (12.73 ft) for two - way traffic. The application was revised, to eliminate the need for variance to the parking space requirements. Furthermore, on -site traffic circulation was revised to allow for one -way traffic, thereby reducing the magnitude of the variance required for the driveway width. ... /2 716 PAGE 2 REPORT PD -74 -97 1.3 In dealing with application A97/032 the Committee approved a reduced exterior side yard setback for the construction of the pool and a reduced rear yard setback for a deck. The application was approved, however, based on the comments of the Public Works Department, the applicant must provide a grading and drainage plan to the satisfaction of the Director of Public Works, within eight (8) weeks of the May 8, 1997 meeting, or the approval becomes null and void. 1.4 Staff have reviewed the Committee's decisions and are satisfied that the decision to approve the applications, including revisions, is in conformity with the Official Plan policies, consistent with the intent of the Zoning By -law, is minor in nature and desirable. 1.5 Council's concurrence with the Committee of Adjustment decisions is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of any decision of the Committee of Adjustment.
