LTD. PT. LOT 30, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON 9 TO 13 AVONDALE DRIVE, COURTICE FILE: DEV 97 -028 (LD 230/95 TO LID 233/95) Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -72 -97 be received; 2. THAT the rezoning application submitted by Halminen Homes /Kiddicorp Inv. Ltd. requesting the removal of the Holding (H) symbol from the zoning for lands subject to Land Divisions 230/95 to 233/95 all inclusive be APPROVED; 3. THAT the attached Amendment to Zoning By -law 84 -63 be APPROVED; and 4. THAT a copy of this report and the attached Amendment be forwarded to the Region of Durham Planning Department; 5. THAT the attached Amendment be circulated in accordance with the Regulations made under the Planning Act; and 6. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. BACKGROUND 1.1 On April 28, 1997, Staff received an application from Kiddicorp Investments Ltd. for the removal of Holding (H) symbol in respect of the area subject to Land Division applications 230/95 to 233/95. The removal of Holding (H) symbol is a condition for the completion of the four land division applications. When these land division applications are complete there will be four 12 -metre minimum frontage, single detached lots fronting on Avondale Drive. 101 REPORT 1.2 The lands subject to the removal of holding application are located in Part Lot 30, Concession 2, Former Township of Darlington, and the lots to be created currently have the municipal addresses of 9 to 13 Avondale Drive, Courtice (see Attachment #1). 1.3 The Holding (H) symbol covers part of the land subject to the four land division applications, specifically, an area which had been reserved for a possible road allowance (see Attachment #2). The draft approval of 18T- 95014, to the south of the subject lands, did not require this road allowance and so, it can be developed for residential use, and hence, the removal of Holding (H) symbol application. 1.4 For the Committee's information, when these four land divisions are complete, there will be an agreement in place to cover the Municipality's financial interest including the payment of parkland dedication and development charges. 1.5 It is to be noted that once the above four lots are created, only two lots will occupy area covered by the Holding (H) symbol (see Attachment #2) and so, the other two lots could be developed without removal of the Holding (H) symbol. The removal of the Holding (H) symbol will facilitate the issuance of building permits for the two lots in the middle of the row comprised of the four lots. 2. STAFF COMMENTS 2.1 Staff advise that the Holding (H) symbol may be removed upon Council being satisfied that the uses to be permitted will be adequately serviced, have adequate access and will be used for purposes intended by the By -law. In reviewing the proposal, Staff are satisfied that the conditions required for the removal of holding have been met. 2.2 Given the above comments, Staff would have no objection to the removal of the Holding (H) symbol as shown on the attached By -law and Schedule (see Attachment #'s 3 and 4). By -law for the Corporation of the former Town of Newcastle. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the Corporation of the former Town of Newcastle in accordance with application DEV 97 -028. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule "4" to By -law 84 -63, as amended, is hereby further amended by changing the zone designation from "Holding -Urban Residential Type Two ((H)R2)" to "Urban Residential Type Two (R2)" as shown on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By -law. 3, This By -law shall come into effect on the date of the passing thereof, subject to the provisions of Section 36 of the Planning Act.
