THAT Report PD -56 -97 be received; 2. THAT the application to amend the Comprehensive Zoning By -law 84 -63 of the former Town of Newcastle, as amended, submitted by 828741 Ontario Limited on behalf of Mr. and Mrs. Bould be DENIED and the application CLOSED. 3. THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: 828741 Ontario Limited 1.2 Owner: Mr. and Mrs. Bould 1.3 Rezoning: From "Urban Residential Type One - Holding ((H)R1)" to an appropriate zone to permit the development of a 500 m2 convenience commercial development. 1.4 Area: 0.16 ha (0.392 acres) 667 REPORT PAGE 2 2.1 The subject lands are located in the Village of Newcastle on the north side of King Street, east of Rudell Road and municipally known as 167 Given Road. The lands are further described as being in Part Lot 30, Concession 2, former Village of Newcastle. • 3.1 The application was originally received in May 1989. The statutory Public Meeting was held September 5, 1989. On February 5, 1990, staff prepared a report recommending the application be held in abeyance pending a master plan being prepared for the triangular land parcel bounded by King Street, Given Road and Rudell Road. This recommendation was identical to a resolution adopted by Council in January of 1990 for an application for commercial development on the adjacent parcel to the west. 3.2 General Purpose and Administration Committee in dealing with the report did not support Staff recommendation but rather recommended approval of the rezoning to permit the development of a 500 m2 convenience commercial use. Council, in dealing with this recommendation on February 12, 1990, did not endorse either the staff recommendation or the General Purpose and Administration resolution, and gave no further direction on this matter. 3.3 The applicant has not taken any further action on this application. Earlier this year, following Ministerial approval of the Clarington Official Plan, staff forwarded a letter to both the applicant and the land owner at the address provided on the application form. Letters to both parties have been returned to the Municipality indicating wrong address. IIWI REPORT NO.: PD -56 -97 PAGE 3 3.4 The Clarington Official Plan, as recently approved, designates the triangular parcel of land "Urban Residential ". This designation would not permit the development of more than 100 m2 of commercial floor area without Official Plan amendment. 4. CONCLUSION 4.1 In consideration of the new Official Plan designation, and the amount of time which has elapsed with no apparent interest in this application and the inability to contact either the owner or agent at the address provided, staff recommend the file be denied and the application closed.
