In Spring 2023, Ontario introduced the Less Red Tape, Stronger Economy Act, 2023 to help build on the government's efforts to reduce burden for businesses, not -for -profit organizations, municipalities and other provincially regulated entities. The Ministry of Infrastructure would like to highlight two measures related to this initiative: 1. Amendments to the Building Broadband Faster Act, 2021 (BBFA) to address barriers to timely municipal permit approvals and efficient infrastructure data collection. 2. Updated guidance to broadband stakeholders through a new version of the Building Broadband Faster in Ontario Guideline. BBFA Amendments The Less Red Tape, Stronger Economy Act, 2023 (formerly Bill 91) received Royal Assent on June 8, 2023, amending the Building Broadband Faster Act, 2021 (BBFA) to remove further barriers or delays to designated broadband project construction and to support a streamlined approach to the deployment of high-speed internet infrastructure in the province. The amendments to the BBFA provided the Minister of Infrastructure with authority to set out certain new regulatory requirements related to infrastructure data collection and conditions for municipal permitting. Effective July 1, 2023, O. Reg. 436/22 Definitions and Prescribed Provisions under the BBFA was amended, by way of a Minister's amending regulation, to set out the following: 1. For infrastructure data collection under s. 20.1 of the BBFA: Upon request from the Minister of Infrastructure, certain persons or entities who own or operate utility infrastructure within 100 metres of a designated broadband project must submit the requested data in the form required by the Minister within 15 business days of receiving the request. 2. For municipal permitting under s. 10.1 of the BBFA: Municipalities may not require proponents to execute a legal agreement in advance of providing access to municipal rights -of -way under s. 10.1 of the BBFA. However, municipalities may require internet service providers (ISPs) to agree in writing to take steps to negotiate such agreements in good faith as soon as reasonably possible as a condition for providing access to their rights -of -way. These changes are intended to advance broadband projects and ensure mechanisms are in place to protect the interests of municipalities. The Ministry of Infrastructure is developing resources to support municipalities with cost recovery related to designated broadband projects and will ensure that appropriate measures are in place to protect data that is shared. Building Broadband Faster in Ontario Guideline (Version 3.0) The Ministry of Infrastructure and Infrastructure Ontario has also updated the Building Broadband Faster in Ontario Guideline (Version 3.0). This Guideline was first released in April 2021 with input from municipalities, ministries, and other partners as a tool to expedite the delivery of designated high-speed internet projects. It was updated in August 2022 as well as in August 2023, to reflect new regulatory requirements that came into effect after its original release. Guideline 3.0 provides additional clarity and best practices for completing work for designated broadband projects in compliance with legislative and regulatory requirements under the BBFA, the Ontario Underground Infrastructure Notification System Act, 2012 (One Call Act) and the Ontario Energy Board Act, 1998 (OEBA). Key updates to the Guideline include: • Information on new regulatory measures, including those under the BBFA mentioned above in addition to amendments to the OEBA and One Call Act regulations. Page 9 A new process to help resolve disputes between parties and work with sectors to ensure that they comply with the laws and regulations that are helping to build broadband faster. Clarity on the Ministry of Transportation's efforts to speed up their permit process for provincially funded broadband projects. • Additional guidance on cost sharing for using electric infrastructure to build these projects. Support Tools Infrastructure Ontario has tools in place that will provide assistance to municipalities, proponents of designated broadband projects and other stakeholders related to new requirements under the legislation and the overall implementation of these projects across the province. These include the Technical Assistance Team (TAT) and the use of an online platform called the Broadband One Window (BOW). The TAT plays a key role in supporting permit applications and facilitating resolutions between stakeholders if disputes arise. BOW will help stakeholders work collaboratively to review and approve permitting applications, share data, and provide progress updates on project milestones. Next Steps In the coming weeks, the Ministry of Infrastructure will engage the Association of Municipalities of Ontario to co -develop resources intended to support municipalities with timely permit approvals while ensuring they can appropriately control access to their rights -of -way. There is still considerable work underway to bring access to high-speed internet to every community in Ontario by the end of 2025. Les changements apport6s a la Loi de 2021 sur la realisation acc6l6r6e de projets d'Internet a haut debit ont permis au ministre de I'Infrastructure de d6finir certaines nouvelles exigences r6glementaires relatives a la collecte de donn6es sur les infrastructures et aux conditions d'octroi des permis municipaux. Depuis le 1 er juillet 2023, le r6glement de I'Ontario 436/22 Definitions et dispositions prescrites, pris en vertu de la Loi de 2021 sur la realisation acc6l6r6e de projets d'Internet a haut debit, a W modifi6, au moyen d'un reglement modificatif du ministre, pour 6tablir ce qui suit : 1. Pour la collecte de donn6es sur les infrastructures en vertu de I'article 20.1 de la Loi de 2021 sur la realisation acc6l6r6e de projets d'internet a haut debit: A la demande du ministre de I'Infrastructure, certaines personnes ou entit6s qui poss6dent ou exploitent des infrastructures de services publics dans un rayon de 100 metres d'un projet de large bande d6sign6 doivent soumettre les donn6es demand6es dans le format requis par le ministre dans les 15 jours ouvrables suivant la r6ception de la demande. 2. Pour les permis municipaux octroy6s en vertu de I'article 10.1 de la Loi de 2021 sur la realisation acc6l6r6e de projets d'internet a haut debit: Les municipalit6s ne peuvent pas exiger des promoteurs qu'ils signent un accord juridique avant de fournir un acces aux emprises municipales en vertu de I'article 10.1 de la Loi de 2021 sur la realisation acc6l6r6e de projets d'Internet a haut debit. Toutefois, les municipalit6s peuvent exiger des fournisseurs d'acc6s Internet qu'ils s'engagent par 6crit a prendre des mesures pour n6gocier de tels accords de bonne foi des que cela est raisonnablement possible, comme condition a la fourniture d'un acces a leurs emprises. Ces changements visent a faire avancer les projets de large bande et a garantir que des m6canismes sont en place pour prot6ger les int6r6ts des municipalit6s. Le ministbre de I'Infrastructure pr6pare des ressources pour aider les municipalit6s a recouvrer les couts li6s aux projets de large bande d6sign6s et veillera a ce que des mesures appropri6es soient mises en place pour prot6ger les donnbes qui sont partag6es. Ligne directrice pour soutenir la r6alisation acc6l6r6e de projets d'Internet a haut debit (version 3.0) Page 12 Le ministbre de ('Infrastructure et Infrastructure Ontario ont egalement mis a jour la Ligne directrice pour soutenir la realisation acceleree de projets d'Internet a haut debit (version 3.0). Cette ligne directrice a ete publiee pour la premiere fois en avril 2021 avec la participation des municipalites, des ministbres et d'autres partenaires, en tant qu'outil permettant d'accelerer la mise en ceuvre des projets d'Internet a haut debit designes. Elle a ete mise a jour en aout 2022 et en aout 2023, afin de prendre en compte les nouvelles exigences reglementaires qui sont entrees en vigueur apres sa publication initiale. La ligne directrice 3.0 fournit des eclaircissements supplementaires et des pratiques exemplaires pour I'achbvement des travaux pour les projets de large bande designes en conformite avec les exigences legislatives et reglementaires en vertu de la Loi de 2021 sur la realisation acceleree de projets d'Internet a haut debit, de la Loi de 2012 sur un systeme d'information sur les infrastructures souterraines en Ontario (Loi sur Ontario One Call Ltd.) et de la Loi de 1998 sur la Commission de 1'energie de 1'Ontario. Les principales mises a jour de la ligne directrice sont les suivantes : • des renseignements sur les nouvelles mesures reglementaires, y compris celles prevues par la Loi de 2021 sur la realisation acceleree de projets d'Internet a haut debit mentionnees ci-dessus, ainsi que sur les modifications apportees aux rbglements de la Loi de 1998 sur la Commission de 1'energie de ('Ontario et de la Loi sur Ontario One Call Ltd.; • une nouvelle procedure pour aider a resoudre les differends entre les parties et travailler avec les secteurs pour s'assurer qu'ils respectent les lois et les rbglements qui contribuent a accelerer la mise en place de la large bande; • 1'eclaircissement des efforts du ministbre des Transports pour accelerer la procedure de delivrance des permis pour les projets de large bande finances par la province; • des directives supplementaires sur le partage des couts lies a ('utilisation de ('infrastructure electrique pour la construction de ces projets. Outils de soutien Infrastructure Ontario a mis en place des outils qui aideront les municipalites, les promoteurs de projets de large bande designes et d'autres parties prenantes a repondre aux nouvelles exigences de la loi et a proceder a la mise en oeuvre globale de ces projets dans toute la province. II s'agit notamment de I'equipe d'assistance technique et de ('utilisation d'une plateforme en ligne appelee Broadband One Window Page 13 (BOW). L'equipe d'assistance technique joue un role cle en soutenant les demandes de permis et en facilitant la resolution des differends entre les parties prenantes. La plateforme BOW aidera les parties prenantes a travailler en collaboration pour examiner et approuver les demandes de permis, echanger des donnees et faire le point sur les etapes du projet. Prochaines etapes Dans les semaines a venir, le ministere de I'Infrastructure invitera I'Association des municipalites de I'Ontario a concevoir conjointement des ressources destinees a aider les municipalites a approuver les permis dans les delais impartis tout en veillant a ce qu'elles puissent controler de maniere appropriee I'acces a Ieurs emprises. Un travail considerable est encore en cours pour permettre a toutes les collectivites de I'Ontario d'acceder A Internet A haut debit d'ici la fin de 2025.
