Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR MEETING OF OCTOBER 2, 1997

Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 154 -97 be received;
2. THAT Council concur with the decision of the Committee of Adjustment made on
October 2, 1997; and
3. THAT staff be authorized to appear before the Ontario Municipal Board to defend
the decision of the Committee of Adjustment in the event of an appeal.
1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications
received by the Municipality for minor variance are scheduled to be heard within
30 days of being received by the Secretary Treasurer. The decisions of the
Committee are detailed below.
1.2 Application A97/056 was tabled for a period of one month or until the next
Committee of Adjustment meeting, to allow the applicant time to revise his
application. Staff comments to the Committee did not support the application.
1.3 Applications A97/057 and A97/058 were applications for large accessory buildings
in a residential estate subdivision. Committee found both of these applications

not to be minor in nature, nor desirable for the neighbourhood; however, each
applicant was permitted to reduce the size of the proposed accessory buildings
and both received approval for reduced structures, 81.3 m2 (875 sq. ft.) and 74.3
m2 (800 sq. ft.) respectively. Staff did not support either application as originally
filed. Both applicants have verbally stated that they intend to appeal these
decisions to the Ontario Municipal Board.
1.4 Application A97/059, also for a large accessory building, was denied as it was not
minor in nature, was considered not in conformity with the intent of the Official
Plan and Zoning By -law and not desirable for the neighbourhood. Strong
opposition to this application was heard from neighbourhood property owners.
1.5 Applications A97/060 and A97/061 were approved as applied for. Application
A96/031 was tabled at two previous hearings on June 27, 1996 and October 24,
1996 to allow the applicant time to satisfy the conditions of various agencies on
a related application for site plan approval. The file was brought back to this
meeting and the application was closed without prejudice.
1.6 Staff have reviewed the Committee's decisions and are satisfied that the
applications approved by the Committee conform to the general intent of the
Official Plan and Zoning By -law, and are minor in nature.
1.7 Council's concurrence with the Committee of Adjustment decision is required in
order to afford staff's official status before the Ontario Municipal Board. In the
event of an appeal of any decision of the Committee of Adjustment, with the
exception of A97/059, staff would attend the hearing to defend the Committee's
decision.
