PART LOT 29, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON FILE: DEV 97 -078 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 153 -97 be received; 2. THAT application for removal of the "Holding (H)" symbol submitted by 290572 Ontario Ltd. be APPROVED as per the attached by -law; 3. THAT the amending By -law attached hereto be forwarded to Council for approval; 4. THAT a copy of this report and the amending by -law be forwarded to the Region of Durham Planning Department; and 5 THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Owner: 290572 Ontario Ltd. 1.2 Rezoning Application: from "Holding -Urban Residential Type One ((H)R1)" to "Urban Residential Type One (R1) ". 1.4 Land Area: 0.05 ha (0.125 acres) 699u 1 REPORT NO. PD- 153 -97 PAGE 2 2. LOCATION 2.1 The subject property is located on the south side of the Avondale Drive, between Brownstone Crescent and Stagemaster Crescent. It is municipally known as 65 Avondale Drive, and legally described as block 38 on Registered Plan 40M -1779. 3. BACKGROUND 3.1 Application for removal of holding was received by the Municipality Planning and Development Department on September 23, 1997. The rezoning is for removal of holding on Block 38 in 40M -1779, which together with Block 52 of 40M -1820 forms a single family dwelling lot. The Holding (H) provision was removed from Block 52 of 40M -1820 in June 1993. 3.2 The applicant together with the adjacent developer, Clarington Development Ltd., are currently attempting to meld the various appropriate blocks from the two registered plans and acquire the necessary lands to complete residential lots on both Avondale Drive and Fieldcrest Avenue. 3.3 Pursuant to Section 36 of the Planning Act, a By -law Amendment to remove the "Holding (H)" symbol is not subject to the normal appeal period afforded to a standard rezoning application, and accordingly shall be deemed final and binding should Council grant approval of same. 4. RECOMMENDATION 4.1 In consideration of the comments noted above, Staff would have no objection to the removal of the "Holding (H)" symbol as shown on the attached by -law and schedule. 6 990 8 REPORT NO. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle to implement application DEV 97 -078. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows; 1. Schedule "4" to By -law 84 -63, as amended, is hereby further amended by changing the zone designation from; "Holding - Urban Residential Type One (R1)" to "Urban Residential Type One (R1)" as illustrated on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By -law. 3. THAT this By -law shall come into effect on the date of the passing thereof, subject to the provisions of Sections 34 and 36 of the Planning Act. BY -LAW read a first time this day of 1997.
