The Corporation of the Municipality of Clarington
By-law Number 2023-053
Being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the
Corporation of the Municipality of Clarington and to lift the Holding "H" provisions on
certain lands located on Broome Avenue, Block 6, 40M-2726 (ZBA2021-0009).
Whereas the Director of Planning & Infrastructure Services of the Municipality of Clarington is
satisfied that the conditions for removing the holding symbol from the "Holding -Urban
Residential Exception ((H)R2-66) Zone on the subject lands, as set out in the Clarington Official
Plan and Zoning By-law 84-63, have been satisfied;
A request has been made to remove "((H)R2-66" holding symbol on the subject lands.
2. Under the authority granted by the Province of Ontario through the Municipal Act, 2001,
S.O. 2001, c.25 and the Planning Act, R.S.O. 1990, c. P.13, Municipal Council has
delegated to the Director of Planning & Infrastructure Services, with the passing of By-
law 2023-014, amending By-law 2001-072, the authority to approve applications to
remove holding symbols and pass related by-laws pursuant to s.34 of the Planning Act.
Now therefore the Director of Planning and Infrastructure Services enacts as follows:
3. Schedule "4" (Courtice)" to By-law 84-63, as amended is hereby further amended by
changing the zone designation from:
"Holding — Urban Residential Exception ((H)R2-66) Zone" to "Urban Residential
Exception (R2-66) Zone";
as illustrated on the attached Schedule "A" hereto.
4. Schedule "A" attached hereto shall form part of the By-law.
5. This By-law shall come into effect on the date of passing hereof, subject to the
provisions of Sections 34 and 36 of the Planning Act.
