Subject: REMOVAL OF HOLDING (DRAFT APPROVED SUBDIVISION 18T- 96002)

Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 142 -97 be received;
2. THAT the rezoning application submitted by D.G. Biddle on behalf of Jane and
Charles Rowe requesting the removal of the Holding (H) Symbol from the zoning
for Lots 1 to 10 all inclusive on Plan 18T -96002 be APPROVED;
3. THAT the attached Amendment to Zoning By -law 84 -63 be APPROVED; and
4. THAT all interested parties listed in this report and any delegation be advised of
Council's decision.
1. BACKGROUND
1.1 Draft Plan of Subdivision 18T -96002 is located in Part Lot 32, Concession 3,
former Township of Darlington.
1.2 On September 19, 1997, Staff received an application from D.G. Biddle on behalf
of Jane and Charles Rowe for removal of Holding (H) Symbol in respect of Lots
1 to 10 all inclusive on Plan 18T- 96002.
1.3 The removal of the Holding (H) Symbol will facilitate the issuance of building
permits for all of the approved lots within Plan 18T- 96002.

1.4 For Committee's information, the lots are located in a draft approved Plan of
Subdivision. The Subdivision Agreement has been finalized and registered on
title. The Municipality's financial interest, including payment of parkland
dedication and development charges are contained within the Agreement.
2. STAFF COMMENTS
2.1 Staff advise that the Holding (H) Symbol may be removed upon Council being
satisfied that the uses to be permitted will be adequately serviced, have adequate
access and will be used for purposes intended by the By -law. In reviewing the
proposal, Staff are satisfied that the conditions required for the removal of holding
have been met.
2.2 Given the above comments, Staff would have no objection to the removal of the
Holding (H) Symbol as shown on the attached By -law and Schedule.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY -LAW NUMBER 97-
being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law for the
Corporation of the former Town of Newcastle
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By -law 84 -63, as amended, of the Corporation of the former Town
of Newcastle in accordance with application DEV 97 -077;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Schedule "4" to By -law 84 -63, as amended, is hereby further amended by
changing the zone designation from "Holding - Urban Residential Type One
((H)R1)" to "Urban Residential Type One (Rl)" zone, as shown on the attached
Schedule "A" hereto.
2. Schedule "A" attached hereto shall form part of this By -law.
3. This By -law shall come into effect on the date of the passing thereof, subject to
the provisions of Sections 34 and 36 of the Planning Act.
BY -LAW read a first time this day of 1997.
