THAT Report PD- 137 -97 be received; 2. THAT application for removal of the "Holding (H)" symbol submitted by the Peterborough Victoria Northumberland Clarington Separate School Board be APPROVED as per the attached by -law; 3. THAT the amending By -law attached hereto be forwarded to Council for approval; 4. THAT a copy of this report and the amending by -law be forwarded to the Region of Durham Planning Department; and 5. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Owner: Towchester Developments Limited 1.2 Applicant: Peterborough Victoria Northumberland Clarington Separate School Board 1.3 Agent: W. M. Salter & Associates Inc. 1.4 Rezoning: from "Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type One (R1)" REPORT NO. PD- 137 -97 PAGE 2 1.4 Land Area: 1.86 ha (4.6 acres) 2. LOCATION 2.1 The subject property is located on the north side of the Longworth Avenue extension, it is generally east of Liberty Street and west of Middle Road. The property_ is _ further described as being located in Part Lot 11, Concession 2, former Town of Bowmanville (see Attachment No. 1). 3. BACKGROUND 3.1 On August 19, 1997, an application for site plan approval and removal of holding was received by the Municipality Planning and Development Department. The site plan is for the development of a 3770 m2 (40,586 sq. ft.) Roman Catholic Elementary School. The block is contained within a draft approved and partially built plan of subdivision. The subject school block is not immediately adjacent to existing development, as a result, the developers, Halloway Holdings and Towchester Developments Ltd. will be extending Longworth Avenue from the west, to a point beyond the east limits of the site, to accommodate a temporary turning circle. The lands are zoned, in part "Urban Residential Type One (R1)" and in part "Holding - Urban Residential Type One ((H)R1) ". The Zoning By -law permits a "Public Use ", such as a school to develop in any zone. 3.2 The site plan application has been circulated to a limited number of agencies for comment. At this time not all the agencies have provided their comments on the site plan. As a result, a site plan agreement has not been executed for the proposed school. However, staff are relatively satisfied that a site plan agreement will be completed shortly. Staff would note, that notwithstanding the removal of the Holding (H) symbol, a building permit would not be issued until the site plan agreement is finalized. Z J REPORT NO. HE Pursuant to Section 36 of the Planning Act, a by -law amendment to remove the "Holding (H)" symbol is not subject to the normal appeal period afforded to a standard rezoning application, and accordingly shall be deemed final and binding should Council grant approval of same. RECOMMENDATION In consideration of the comments noted above, staff would have no objection to the removal of the "Holding (H)" symbol as shown on the attached by -law and schedule. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle for DEV 97 -068. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule "3" to By -law 84 -63, as amended, is hereby further amended by changing the zone designation from: "Holding - Urban Residential Type One ((H)R1) Zone" to "Urban Residential Type One (R1) Zone" as illustrated on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By -law. 3. THAT this By -law shall come into effect on the date of the passing thereof, subject to the provisions of Sections 34 and 36 of the Planning Act. BY -LAW read a first time this day of 1997.
