CONCESSION FORMER TOWNSHIP OF DARLINGTON APPLICANT: RIDGE PINE PARK INC. FILES: COPA 97 -006; DEV 97 -054 (X -REF: ROPA 97 -017) Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 134 -97 be received; 2. THAT the applications to amend the Durham Regional Official Plan, the Clarington Official Plan and the Comprehensive Zoning By -law 84 -63 of the former Town of Newcastle, submitted by Roger Howard on behalf of Ridge Pine Park Inc. be referred back to staff for further processing and the preparation of a subsequent report following the receipt of the outstanding agency comments; and 3. THAT the Durham Region Planning Department and all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Owners: Ridge Pine Park Inc. 1.2 Agent: Roger Howard 1.3 Regional Official Plan Designation: from "Permanent Agricultural Reserve" to permit a nine -hole golf course 1.4 Clarington Official Plan Designation: from "Prime Agricultural Area" to permit a nine -hole golf course. The proposed Clarington Official Plan Amendment submitted by the Applicant is included in this report as Attachment #3. REPORT NO.: PD- 134 -97 PAGE 2 1.5 Zoning: from "Agricultural (A)" to an appropriate zone that would permit a nine -hole golf course. 1.6 Area: 14 hectares (34.6 acres) 2. BACKGROUND 2.1 On July 4, 1997, the Planning and Development Department received an application to amend the Official Plan of the Municipality of Caarington and an application to amend Zoning By -law 84 -63 in order to permit a nine -hole golf course on the subject property. The proposal does not include clubhouse facilities and so, sanitary facilities will be minimal, eg. toilet with a holding tank. 2.2 On August 11, 1997, the Regional Planning Department notified the Planning and Development Department that an application for a Regional Official Plan Amendment had been submitted in order to permit a nine -hole golf course on the subject property. 2.3 The area subject to the proposal is located south of Highway 401, north of the Canadian National Railway, east of the private road - Wilmot Creek Drive and west of the Highways 401 and 35/115 interchange. The more formal location description is Part Lots 2 and 3, Broken Front Concession, former Township of Darlington. The subject property will be accessed from Wilmot Creek Drive. 3. PUBLIC NOTICE AND SUBMISSIONS 3.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands (on Wilmot Creek Drive at the west end of the site). Also, copies of the Notice of Public Meeting and the associated subject site key map were posted in the Wilmot Creek Recreation Centre. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. C '.s t_ REPORT NO.: PD- 134 -97 PAGE 3 It is noted that the Region of Durham will be holding a separate Public Meeting on October 14, 1997 with respect to the proposed Durham Regional Official Plan Gu-TA!u-i 3.2 As a result of the public notification process, the Planning and Development Department has received two inquiries. Both inquiries involved the status of the existing golf course and what plans, if any, were being proposed. Staff would note Ridge Pine Park Inc. has indicated it plans to continue using the existing golf course along the Lakeshore, thereby offering future Wilmot Creek Community residents two golf courses. 4. OFFICIAL PLAN CONFORMITY 4.1 Within the Durham Regional Official Plan, the subject property is designated as Permanent Agricultural Reserve. The proposal does not conform and so, a Regional Official Plan Amendment application has been submitted. 4.2 Within the Clarington Official Plan, the subject property is designated as Prime Agricultural Area. The proposal does not conform and hence, the submission of an Amendment to the Clarington Official Plan. 5. ZONING BY -LAW COMPLIANCE 5.1 Within Comprehensive Zoning By -law 84 -63 of the former Town of Newcastle, the subject property is zoned "Agricultural (A) ". A golf course is not a permitted use, therefore, does not conform and hence, the submission of this rezoning application. 6. AGENCY COMMENTS 6.1 The Clarington Official Plan Amendment and rezoning applications were circulated to various agencies and other departments by the Planning and Development Department. The Clarington Economic Development Office, Fire Department, REPORT NO.: PD- 134 -97 PAGE 4 Public Works Department and the Regional Health Department offered no objections to this proposal. Other comments received to date are as follows. 6.2 The Canadian National Railway requested that three concerns be addressed. 1) The Zoning By -law Amendment should include a minimum building setback of 120 metres, or 30 metres in conjunction with a 2.5 metre safety berm, from the railway right -of -way for any building which promotes public assembly (ie. clubhouse, rental /sales outlet, restaurant, etc.). 2) The Owner shall install and maintain at his own expense, a chain link fence of minimum 1.83 metres height along the mutual property line. In order to ensure that there will not be any problem with trespassing or other encroachment onto CN property a higher fence and /or netting may be necessary. 3) Any proposed alterations to the existing drainage pattern affecting Railway property must receive prior concurrence from the Railway and be substantiated by a drainage report to the satisfaction of the Railway. 6.3 The Regional Planning Department noted the proposal was also subject to an application to amend the Durham Regional Official Plan and that should the Clarington Official Plan Amendment be adopted, approval consideration will not be given until the corresponding Regional Official Plan Amendment has been approved by the Ministry of Municipal Affairs. 6.4 The Regional Works Department noted there are no municipal services available for the subject lands and it has no plans to make them available and so, the only feasible method of servicing available is the installation of private wells and private waste disposal systems. REPORT NO.: PD- 134 -97 PAGE 5 6.5 Comments remain outstanding from Ontario Hydro and Central Lake Ontario Conservation. 7. STAFF COMMENTS 7.1 As the purpose of this report is to give the status of the application for the Public Meeting, it is appropriate to have the application referred back to staff for further processing. Location: The area subject to the proposal consists of approximately 35 acres and is located south of Highway 401, north of the Canadian National Railway, east of the private road - Wilmot Creek Drive, and west of the Highways 401 and 35/115 interchange. The more formal location description is Part Lots 2 and 3, Broken Front Concession, former Township of Darlington. Basis: The Official Plan permits golf courses in the Agricultural Area designation subject to the approval of an Official Plan Amendment. An application for such an amendment has been reviewed on the basis of criteria set out in the Official Plan for golf courses in Agricultural Area designations. As a result of this review, the Amendment is considered appropriate. Actual Amendment: The Official Plan for the Municipality of Clarington is hereby amended as follows: i) by adding the following new subsection to read as follows: "13.4 EXCEPTIONS 13.4.1 In accordance with Section 13.3.4, a golf course is permitted on Part of Lots 2 and 3, Broken Front Concession, former Township of Darlington, identified in the Assessment Roll as Nos. 18 -17- 010 - 010 -005, north of the Canadian National Railway, and 18-17- 010 -010- 00510, north of the Canadian National Railway." 6 U0
