Subject: MONITORING THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETING OF SEPTEMBER
FILES: A97/049 TO A97/053 INCLUSIVE
Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council he following
1. THAT Report PD- 131 -97 be received;
2. THAT Council concur with the decisions of the Committee of Adjustment made
on September 4, 1997; and
3. THAT Staff be authorized to appear bef Adjustment the event of and appealo defend
the decision of the Committee of
1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications
received by the Municipality for minor variance are scheduled to be heard within
30 days of being received by the Secretary Treasurer.
1.2 The Committee heard five applications at the September 4, 1997 meeting. Four
of the applications were approved as applied for.

1.3 Application A97/052 was approved in part to recognize an exterior side yard and
rear yard reduction to 0 metres for an existing pool and deck, and to recognize
a site triangle, at the corner of Homefield Square reduced to 7.0 metres, by an
existing fence, as opposed to the required 7.5 metres. The approval was
conditional upon the applicant removing the part of the fence and deck structure
which are .currently encroaching on the municipal road allowance, by July 1,
1998.
The last part of the application, which was denied, proposed to recognize a
second deck on the property with a 0 metre interior side yard setback.
1.4 Staff have reviewed the Committee's decisions and are satisfied that the decision
to approve the applications, is in conformity with the Official Plan policies,
consistent with the intent of the Zoning By -law, minor in nature and desirable.
1.5 Council's concurrence with the Committee of Adjustment decisions is required in
order to afford Staff's official status before the Ontario Municipal Board in the
event of an appeal of any decision of the Committee of Adjustment.
