Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 129 -97 be received;
2. THAT the application to amend the Comprehensive Zoning By -Law 84 -63 of the
former Town of Newcastle, as amended, submitted by Robert and Margaret Weir
be referred back to Staff for further processing and preparation of a subsequent
report pending receipt of all outstanding comments; and,
3. THAT the Durham Region Planning Department, and all interested parties listed
in this report and any delegation be advised of Council's decision.
1. APPLICATION DETAILS
1.1 Applicant: Robert and Margaret Weir
1.2 Rezoning: from "Light Industrial (M1)" to an appropriate zone to permit
outside storage as accessory to a permitted industrial use.
1.3 Area: 0.51 ha (1.26 acres)
2. LOCATION
2.1 The subject lands are located south of the Highway 401, on the northeast corner
of Lake Road and Butler Court. The lands are further described as part of Block
9 on registered plan of subdivision 10M -831.

3. BACKGROUND
3.1 An application for rezoning was received August 11, 1997, to permit outside
storage as accessory to a permitted industrial use on the subject lands. The
application has been circulated to a limited number of agencies for comments.
The parcel is to be developed for a building supply operation.
4. EXISTING AND SURROUNDING USES
4.1 Existing Uses: Vacant land
4.2 Surrounding Uses:
East: Vacant industrially zoned land
North: Vacant industrially zoned lands and Hwy. 401
West: Imperial Oil's fuel depot and vacant industrial lots
South: Vacant industrially zoned lands
5. OFFICIAL PLAN POLICIES
5.1 Within the existing 1991 Durham Region Official Plan, the subject property is
designated "Employment Area ". Lands designated as such shall be used for an
array of industrial, research and development and personal service uses. Storage
of goods and materials is also permitted.
The application would appear to conform.
5.2 Within the Clarington Official Plan, the subject lands are designated "Light
Industrial ". Said designation is typically located in places of high visibility along
major arterial roads and freeways. The light industrial designation permits
manufacturing, assembling, processing, fabricating, repairing, research and
development and warehousing. Certain commercial, community and recreational
uses, including banks, restaurants, athletic clubs, banquet facilities and fraternal
organizations, which are limited in scale, are also permitted.

5.3 Outside storage is permitted in the Light Industrial designation, based on the
following criteria:
• a maximum 25% of the total gross building floor area;
• materials stored shall not exceed a height of 3 metres; and
• storage areas shall be primarily located in the rear of the lot and
appropriately screened.
6. ZONING BY -LAW PROVISIONS
6.1 The current zoning of the subject property is "Light Industrial (M1) ". The M1 zone
in the Municipality's Zoning By -law, 84 -63, as amended, predates the Clarington
Official Plan. As a result, the zoning is not reflective of all the uses permitted in
the Light Industrial designation. One such use not permitted in the M1 zone is
outside storage.
7. PUBLIC NOTICE AND SUBMISSION
7.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the
Planning Act the appropriate signage acknowledging the application was installed
on the subject lands. In addition, the appropriate notice was mailed to each
landowner within the prescribed distance.
8. AGENCY COMMENTS
8.1 In accordance with departmental procedures, the application was circulated to
obtain comments from other departments and agencies. Both the Clarington
Public Works and the Fire Department have advised they have no objection to the
proposed rezoning.
8.2 Comments remain outstanding from the Region of Durham Planning and Works
Department, the Ministry of Transportation and the Central Lake Ontario
Conservation Authority.

9. STAFF COMMENTS
9.1 The proposed zoning amendment to permit outside storage is consistent with the
policies of the Clarington Official Plan for limited area equal to 25% of the floor
area of the future industrial building. The applicant has not provided details with
respect to the amount or location of outside storage, or the size of future
industrial building proposed. The owner will be required to make site plan
application prior to development of the site. Said application will detail location
and areas for both the building and outside storage.
10. CONCLUSION
10.1 The purpose of this report is to facilitate the Public Meeting as required by the
Planning Act, to provide Committee and Council with some background on the
application submitted. It is recommended the application be referred back to
Staff for further processing and subsequent report upon receipt of all outstanding
comments.
