PART LOT 13 & 14, CONCESSION 3, FORMER TOWNSHIP OF DARLINGTON FILE: DEV 97 -059 (X -REF: COPA 97 -010) Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 128 -97 be received; 2. THAT application to amend the Comprehensive Zoning By -law 84 -63 of the Corporation of the former Town of Newcastle, as amended, submitted by Quarry Lakes Golf and Recreation Centre Inc. on behalf of 667433 Ontario Ltd. be referred back to staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT the Durham Region Planning Department and all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: Quarry Lakes Golf and Recreation Centre Inc. 1.2 Owner: 667433 Ontario Ltd. 1.3 Agent: G. M. Sernas & Associates 1.4 Rezoning: from "Extractive Industrial (M3)" to an appropriate zone to permit the development of an 18 hole, par 3 golf course, driving range, mini putt, clubhouse and maintenance facility. 1.5 COPA: to permit a golf course within the Green Space designation 1.6 Area: 30.26 ha (74.77 acres) REPORT NO. LOCATION 2.1 The subject property has approximately 572 metres (1876.6 feet) of frontage on the east side of Regional Road 57, south of Concession Road 4 and 148 metres (485.5 feet) of frontage on Middle Road. The property is further described as being in Part Lots 13 and 14, Concession 3, former Township of Darlington. 3. BACKGROUND 3.1 Applications were received July 31, 1997 by the Planning Department for both amendments to the Clarington Official Plan and the Comprehensive Zoning By- law. As noted in Section 1 above, "Application Details ", the official plan amendment application is required for the proposed golf course, while the rezoning, in addition to the golf course, deals with the driving range, mini -putt, clubhouse and maintenance buildings. 3.2 In support of the application, the applicant has submitted the following documents: • Planning Report - Quarry Lakes Golf Centre, prepared by G. M. Sernas & Associates Ltd., July 1997 • Report - Soil and Hydrogeologic Investigation Proposed Estate Residential Subdivision Regional Road 57 (Bowmanville) Town of Newcastle, prepared by Walter H. Gibson & Associates Ltd., June 1986. e Report - Hydrogeologic Assessment Proposed Par -3 Golf Course, Part of Lots 13 and 14, Conc. 3 (Darlington) Municipality of Clarington, prepared by Walter H. Gibson & Associates Ltd., August 1997. 4. EXISTING AND SURROUNDING USES 4.1 Existing Uses: The subject property is vacant. The lands are a former quarry and are characterized by a large pond on the narrow portion, east half of the lot. REPORT NO. PD- 128 -97 PAGE 3 The balance of the lands are covered with brush and grasses. Although the lands are relatively flat, there is evidence of construction debris having been dumped on the lands. The applicant's agent has been requested to submit a "Site Screening Questionnaire" and follow the Council approved procedures for contaminated site identification. 4.2 Surrounding Uses: East - limited residential fronting on the west side of Middle Road and the Bowmanville Golf and Country Club. West - existing estate residential subdivisions west of Regional Road 57. South - limited residential and vacant lands North - vacant scrub lands 5. OFFICIAL PLAN POLICIES 5.1 Within the Durham Regional Official Plan the subject property is designated major Open Space. The predominant use of land within this designation shall be for conservation, recreation, reforestation and agriculture and farm - related uses. The establishment of golf courses shall require an amendment to either the Regional Plan or a local Official Plan and subject to certain policies. 5.2 Within the Clarington Official Plan the subject lands are designated Green Space 5.3 Lands within the Green Space designation shall be used primarily for conservation and active or passive recreational uses. The mini -putt and driving range component of the proposed development are permissable, however, the golf course component requires and amendment to the Official Plan. 6 J REPORT NO. PD- 128 -97 PAGE 4 5.4 Map C identifies the approximate location of known natural features and land characteristics. Section 4.3.8 states "An Environmental Impact Study shall be undertaken for development applications located within or adjacent to any natural features identified on Map C." The subject lands are located within the Lake Iroquois Beach and are impacted by tableland woodlots. In accordance with the guidelines approved by Council, Draft Terms of Reference for the EIS have been prepared and forwarded to three agencies (CLOCA, Regional Planning and Regional Health), plus the applicant's consultant for comment. At such time as the terms of reference are finalized, a consultant will be selected to undertake the study. The cost of the study will be borne by the proponent. 6. ZONING BY -LAW PROVISIONS 6.1 The subject lands are zoned "Extractive Industrial (M3) ". Said zone would not permit the proposed development hence the application. Amendment to the By- law is required. 7. PUBLIC NOTICE AND SUBMISSIONS 7.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition the appropriate notice was mailed to each landowner within the prescribed distance. 7.2 A number of area residents have contacted the Planning Department with respect to this application. Although no one has voiced opposition to the proposal, questions with respect to possible removal of the trees and impact on ground water and neighbouring wells were raised. O LO REPORT NO. PD- 128 -97 PAGE 5 8. AGENCY COMMENTS 8.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. At this time comments remain outstanding from a number of agencies, including; Clarington Public Works, Regional Planning, Regional Works, Regional Health, Central Lake Ontario Conservation and Ontario Hydro. 8.2 The Clarington Fire Department has advised they have no objection to the proposal as submitted. 9. STAFF COMMENTS 9.1 As noted in Sections 1 and 2 of this report, the applicant has submitted both an Official Plan Amendment application, as well as a rezoning application. The applicant and his agent have advised staff that they wish to proceed with the rezoning for the driving range component of the proposal immediately, while the official plan amendment for the golf course is being processed. The driving range component of the proposed development does not require an official plan amendment. 9.2 The draft EIS terms of reference require the selected consultant to conduct a two - phase Environmental Impact Study. Phase 1 will include a review of existing background materials and studies, supplemented by limited field work, culminating in an Issues Summary Report which addresses whether, the driving range component of the proposal may be excluded from the balance of the required EIS. Phase 2 will provide a more detailed review of the natural features in order to determine if the proposal is feasible from an environmental perspective and what, if any, mitigative measures are required. CONCLUSION 10.1 The purpose of this report is to facilitate the Public Meeting as required by the Planning Act, to provide Committee and Council with some background on the application submitted and for staff to indicate issues regarding the subject application. It is recommended the application be referred back to Staff for further processing and subsequent report upon resolution of the above issues and receipt of all outstanding comments.
