THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: Mr. Walter John Hale 1.2 Agent: Mr. Sam L. Cureatz, Barrister and Solicitor 1.3 Application: From "Agricultural Exception (A -1)" to an appropriate zone that would permit five (5) single detached lots. 1.4 Site Area: 2.05 hectares (5.07 acres) 2. BACKGROUND 2.1 On July 17, 1997, the Planning and Development Department received an application to amend Zoning By -law 84 -63 in order to permit the development of five (5) single detached lots. REPORT NO. PD- 126 -97 PAGE 2 2.2 The area subject to the proposal is immediately northeast of the intersection of Hill Street and Reid Road in Newtonville. The more formal location description is Part Lot 10, Concession 2, former Township of Clarke. 3. PUBLIC NOTICE AND SUBMISSIONS 3.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition the appropriate notice was mailed to each landowner within the prescribed distance. 3.2 As a result of the public notification process, to date, the Planning and Development Department has received only one telephone inquiry. The telephone inquiry was from a Newtonville resident and it concerned general questions such as the development's timing, lot size, unit type, unit orientation and servicing. 4. OFFICIAL PLAN CONFORMITY 4.1 Within the Durham Regional Official Plan, the subject property is in the designated Hamlet of Newtonville. 4.2 Within the Clarington Official Plan, the subject property is designated as Hamlet Residential within the Hamlet of Newtonville. 5. ZONING BY -LAW COMPLIANCE 5.1 Within Comprehensive Zoning By -law 84 -63 of the former Town of Newcastle, the subject property is zoned "Agricultural Exception (A -1)" which permits, among other uses one single detached dwelling per an existing lot of record. As the proposal is for a 5 lots development, rezoning is required. REPORT NO. PD- 126 -97 PAGE 3 NMW 6.1 The rezoning application was circulated to various agencies and other departments by the Planning and Development Department. The Fire Department, the Regional Health Department and Ontario Hydro offered no objections to the application. Other comments received to date are as follows. 6.2 The Clarington Public Works Department - Engineering Division stated the applicant /owner must provide this department with a Lot Grading Plan satisfactory to the Director of Public Works and a Grading and Drainage Deposit in the amount of $5,000.00 (5 new dwelling units x $1,000.00 per unit). This deposit will be refunded when all grading /drainage work is completed to the satisfaction of the Director of Public Works. It was also noted the applicant will be required to make application for property access in conjunction with this proposal and that the applicant is responsible for any costs necessary to facilitate the construction of entrances from the subject property to Hill Street. The cost of providing connecting accesses may include utility relocation, culverts, entrance paving, ditching, restoration etc. The Clarington Public Works Department - Parks Division stated the applicant will be required to provide a 5% cash contribution in lieu of the normal parkland dedication. 6.3 The Ganaraska Region Conservation Authority noted that as these lots are large rural residential lots, only a generalized site grading and drainage plan is requested. Stormwater quantity and quality are not a concern with the scope of this development. 6.4 The Regional Planning and Development Department, noted the subject property is designated "Hamlet" within the Durham Regional Official Plan, which permits the 6 � .7 REPORT NO. PD- 126 -97 PAGE 4 proposed use. It was also stated that within the above Plan, Policy 20.7.2 states "three additional lots may be considered as the maximum number of lot divisions by severance." New residential lots in any Rural Settlement Area shall meet the requirements of the Regional Health Services Department. Municipal water supply is available to the subject lands from an existing 200 mm water main on Hill Street. The proposed development will be required to connect to the existing water main. Municipal sanitary sewers are not available in this area of Clarington and so, the only feasible method of waste disposal would appear to be through private means. The Region does not object to the continued processing of this application. 6.5 Comments remain outstanding from: the public school board and the separate school board. 7. STAFF COMMENTS 7.1 As the purpose of this report is to give the status of the application for the public meeting, it is appropriate to have the application referred back to staff for further processing.
