THAT Report PD- 119 -97 be received; 2. THAT the application to amend the Comprehensive Zoning By -law 84 -63 of the former Town of Newcastle, submitted by The Kaitlin Group Limited be APPROVED; 3. THAT the amending By -law attached hereto be forwarded to Council for approval; 4. THAT Durham Region Planning Department and all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: The Kaitlin Group Limited 1.2 Rezoning: "Agricultural (A)" to an appropriate zone to permit the development of five (5) residential lots, for 10 linked dwelling units. The development would complete Abernethy Crescent. 1.3 Area: 0.295 ha 2. LOCATION 2.1 The subject property is located in Part Lot 15, Concession 1, in the former Town of Bowmanville and fronts on Abernethy Crescent. REPORT NO. PD- 119 -97 3. BACKGROUND 3.1 Application for rezoning was received by the Municipality's Planning Department on May 22, 1997. The lands in question were originally part of a larger parcel having frontage onto Martin Road. With the progressing development of the Aspen Springs subdivision surrounding the property, the applicant has recently received the approval of the Land Division Committee to sever off the subject lands with the intention of completing the residential development fronting onto Abernethy Crescent. 4. EXISTING AND SURROUNDING USES 4.1 Existing Uses: single detached dwelling and barn 4.2 Surrounding Uses: West - existing residential East - existing residential South - existing residential North - existing residential 5. OFFICIAL PLAN POLICIES 5.1 Within the Durham Region Official Plan the subject property is designated "Living Area ". Lands within this designation are to be used for housing purposes predominantly. The proposal would conform with this policy. 5.2 Within the Municipality of Clarington Official Plan the subject property is designated "Urban Residential ". The predominant use of lands within the Urban Residential designation shall be for housing purposes. The proposal would conform with this policy. 6. ZONING BY -LAW PROVISIONS I 6.1 The site is currently zoned Agricultural (A) ". This zone permits one single detached dwelling and buildings and structures accessory thereto per lot. The proposed residential uses are not currently permitted. REPORT NO. PD- 119 -97 PAGE 3 7. PUBLIC NOTICE AND SUBMISSIONS 7.1 Pursuant to the requirements of the Planning Act, a public meeting was held on July, 7, 1997. Only the applicant appeared at the public meeting. Staff did receive one telephone inquiry wishing to confirm the number of lots and type of dwelling units being proposed. 8. AGENCY COMMENTS 8.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following department /agencies in providing comments, offered no objection to the application as filed: Regional Planning and Public Works; Clarington Public Works Department; the Clarington Fire Department; and Central Lake Ontario Conservation. 9. STAFF COMMENTS 9.1 The applicant is proposing to complete the development of Abernethy Crescent. The 0.295 ha parcel will be eventually divided through the land division process to create five (5) new lots, which will accommodate five sets of linked dwellings, for a total of ten (10) homes. 9.2 Land Division applications LD 190/97 to LD 193/97 inclusive were heard at the June 14, 1997 meeting and all received approval, subject to various conditions requested by the Region of Durham and the Municipality of Clarington. 9.3 The Central Lake Ontario Conservation Staff noted that the subject property was previously identified through the Westside Creek Master Drainage Plan, and confirmed that in as much as the proposed lots back onto a stormwater channel leading to the existing pond facility the proposed lots are outside the floodplain associated with this channel. 10. CONCLUSION 10.1 In consideration of the comments received, staff would recommend that this application and the attached By -law be APPROVED. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the Corporation of the former Town of Newcastle in accordance with application DEV 97 -027. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule "3" to By -law 84 -63 as amended, is hereby further amended by changing the zone designation from: "Agricultural (A)" to "Urban Residential Type One (R1)" as shown on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By -law. 3. This By -law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act.
