THAT Report PD- 115 -97 be received; 2. THAT the request submitted by 1081568 Ontario Incorporated for removal of the Holding (H) symbol be APPROVED; 3. THAT the attached by -law be forwarded to Council for approval; and 4 THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. BACKGROUND 1.1 On August 1997 Staff received an application from 1081568 Ontario Incorporated for the removal of Holding (H) symbol in respect of the area subject to Land Division application LD 124/95. All conditions of this land division application have been fulfilled and the deeds have been stamped by the Land Division office. 1.2 The subject lot is located in Part of Lot 28, Concession 1, in the former Village of Newcastle, known as 20 Robert Street West. The removal of the holding symbol on the property will facilitate the leasing of units within the existing building, to be used for medical /dental clinic and administrative, professional and business offices. 66_J REPORT NO.: PDA 15 -97 PAGE 2 1.3 Staff would note for the Committee's information that site plan approval has been issued for the use of the existing building for a medical /dental clinic and administrative, professional and business offices. 2. STAFF COMMENTS 2.1 Staff advise, for Committee's information, that the Holding (H) symbol may be removed upon Council being satisfied that the uses to be permitted will be adequately serviced, have adequate access and will be used for purposes intended by By -law 84 -63. In reviewing the proposal, staff are satisfied that the conditions required for the removal of the Holding (H) symbol have been met as a site plan agreement has been entered into with the Municipality. 2.2 In consideration of the comments noted above, staff would have no objection to removal of the Holding (H) symbol as shown on the attached By -law and Schedule. Stockwell Chief Administrative Officer Attachment #1 - Site Location Map Attachment #2 - Zoning By -law Amendment and Schedule 'A' Interested parties to be notified of Council and Committee's decision: 1081568 Ontario Incorporated 85 King Street West Unit 2 Bowmanville, Ontario 664 CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY -LAW 97- being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law for the Corporation of the former Town of Newcastle WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the Corporation of the former Town of Newcastle in accordance with application DEV 97 -062; NOW THEREFORE BE IT RESOLVED THAT Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule 115" to by -law 84 -63, as amended, is hereby further amended by changing the zone designation from "Holding - Urban Residential Type One Exception ((H)R1- 38)" to "Urban Residential Type One Exception (R1 -38)" as shown on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By -law. 3. This By -law shall come into effect on the date of the passing thereof, subject to the provisions of Section 36 of the Planning Act.
