CS -19 -83 SUBJECT: GPA RESOLUTION # 768 -83 "STEPHENSON REQUEST FOR EXEMPTION FROM THE TOWN OF NEWCASTLE CEMETERY BY -LAW" RECOMMENDATION: 1. That this report be received for information; and 2. That the request of Mr. L. Stephenson for exemption from the By- flaw #79 -104 not be approved. BACKGROUND & COMMENTS: In the letter dated September 14th, 1983, Mr. Lloyd Stephenson of Newcastle Village requested that Council give consideration to exempting him from the section of the Cemetery By -Law related to the size of the stone and its base. By -Law 79 -104 has been before Council and the contents of the By -Law have been reconfirmed by Council. The purpose of the section relating to the size of stones and bases is to establish uniformity and permit their easy removal when the occasion arises, particularly when adjacent plots have to be opened. Itis my understanding that there are a number of people awaiting the out- come of this application. It is staff's opinion that Council should not grant exemption to the By -Law. Rather, the problem of oversized stones should be turned back to the point of origin, that is, the manufacturer of the stone and that the purchaser require him to cut the stone to proper size or replace it. ../2 I`lu `r 3(9) REPORT NO. CS -I9 -83 Page 2. The By -Law is clear in what is permitted and it should not be up to the municipality to providealternative solutions to a manufacturer's problem. Respectfully submitted, Thomas A.
