REPORT TO COUNCIL MEETING OF JULY 25, 1983.
REPORT NO: WD -69 -83
SUBJECT: RESOLUTION NOS. GPA- 666 -83 & GPA - 667 -83.
PERMISSION TO ENCROACH UPON TOWN -OWNED LANDS.
QUEEN STREET, BOWMANVILLE.
RECOMMENDATION:
It is respectfully recommended:
1. That permission be granted to Robert Kenneth Roman
and Sheila Roman, 54 Queen Street, Bowmanville, their
heirs, successors and assigns, the right to maintain
and use such portion of the building as constitutes
an encroachment upon a public highway, for so long as
the encroachment is not required for municipal purposes,
and;
2. That the attached by -law to permit the continuation of an
encroachment onto Town -owned lands, by Robert Kenneth
Roman and Sheila Roman, 54 Queen Street, Bowmanville,
of Part3, Plan 1OR -1656, be enacted.
BACKGROUND AND REPORT:
At General Purpose & Administration Committee of Monday, July 18, 1983,
Mr. Lucien Michaels appeared as a delegation to request the Town to
pass a by -law to permit the continuation of an encroachment onto
WD -69 -83
- 2 -
Queen Street, Bowmanville; the encroachment is caused by a roofed
porch and steps which protrude two (2) feet onto the sidewalk.
Staff have investigated the site and feel that the encroachment
has no detrimental effect on vehicular or pedestrian traffic on
Queen Street, and can see no reason why it should not be allowed
to continue, until or unless the Town ever has need of the full
width of the street for construction or other municipal works.
The attached by -law is recommended for enactment and details the
encroachment as Part 3, Plan 10R -1656; the reference plan is to be
included in the by -law as Schedule "A ".
Respectfully submit d,
D.T. Gray, C.E.T.,
Deputy Director of Public Works.
