SUBJECT: RELEASE OF DEVELOPMENT AGREEMENT
SOLINA INVESTMENTS LIMITED - INDUSTRIAL
SUBDIVISION - LOT 30, CONCESSION 1,
FORMER TOWNSHIP OF DARLINGTON
REGISTERED PLAN 10R813 - (Our File: D -30 -1)
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the Director of Public Works be authorized to
issue a Certificate of Acceptance for the works
constructed in this subdivision in accordance with the
Development Agreement between Solina Investments
Limited and the Corporation of the Town of Newcastle;
and,
3. That the Town solicitor prepare the necessary
documentation for the execution and final release of
the Development Agreement; and,
4. That the Mayor and Clerk be authorized to issue the
Certificate of Release on behalf of the Town.

BACKGROUND AND REPORT
In April of 1978, The Town of Newcastle entered into a
Development Agreement with Solina Investments Ltd., to
construct an industrial subdivision in Lot 30, Concession 1,
former Darlington Township. At the Council Meeting held on
January 26, 1981, the following resolution was adopted:
"That the Solina Investments Industrial
Subdivision be placed on the Maintenance Program
for a two -year period from December 31, 1980,
and that a Certificate of Completion be issued
in accordance with the terms of the Subdivision
Agreement ".
The subdivision has been inspected by the Public Works
Department and the owners have constructed and maintained
the works in accordance with the terms and conditions of the
amended development agreement and to the satisfaction of the
Town of Newcastle. The owners have indicated that they have
complied with all requirements of the agreement and it is
hereby recommended that a final release be executed.
