(416) 263 -2231 987 -5039 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF OCTOBER 17, 1983. REPORT NO: WD -86 -83 SUBJECT: CONVEYANCE TO ABUTTING PROPERTY OWNERS OF THE ROAD ALLOWANCE IN LOTS 31 & 32, BETWEEN CONCESSIONS 8 & 9, FORMER TOWNSHIP OF CLARKE. (CLOSED BY BY -LAW 81 -4). RECOMMENDATION: It is respectfully recommended: 1. That Report WD -86 -83 be received; and, 2. That the road allowance located in Lots 31 & 32, between Concessions 8 & 9, former Township of Clarke, which was closed by By -Law 81 -4, be disposed of by sale and conveyance to the abutting owners thereto; and, 3. That the value of $1,000 (One Thousand Dollars) per acre be established for the lands to be sold; and, 4. That Staff be authorized to pursue Town Policy and Procedure in this matter, and the interested owners be so advised. BACKGROUND AND REPORT: In 1981, as a result of a request from abutting property owners, the Town of Newcastle enacted By -Law 81 -4, closing the subject road allowance. At that time there was no request for conveyance of the lands comprising the road allowance, and the by -law did not include 6-" the provision or authorization for it's disposal.;j, V- iCo The road allowance in question is intersected by a Forced Road which, some years ago, in consideration for lands required for intersection improvements to facilitate the construction of Salco Road, was conveyed to Mr. Carleton F. Wilson. The lands described are of no foreseeable value to the Town, and the abutting owners have indicated they presently endure trespass and damages to their property from the intrusion of all terrain vehicles, etc. The owners would be better able to protect their holdings if they had ownership of the road allowance, and the right to fence off all points of access to their lands. Attached is a plan, which is a composite of two separate surveys Nos. 10R -9:1)'5 and 10R -1201. This shows the road allowance in total, as it bisects Concessions 8 & 9. There are three property owners involved, and the disposition of lands would be as follows: Northerly: Mr. Carleton F. Wilson (Lot 32) North half of Part 19, 1OR -915 & Part 1, 10R -1201. Mr. Stuart MacKay (Lot 31) Part 3, Plan 10R -1201. Southerly: Dunn Sand & Gravel (Lot 32). South half of Part 9, 10R -915 & Part 2, 10R -1201. Mr. Stuart MacKay (Lot 31) Part 4, Plan 10R -1201. It is recommended that this road allowance be disposed of and that 1 the value of lands comprising same be established in accordance with Clause 6 (d) of Town Policy and Procedure, i.e. $1,000 per acre, with the benefitting owners being responsible for all costs incurred in finalizing the transactions.
