(416) 263.2231 967.5039 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF DECEMBER 5, 1983. REPORT NO.: WD ®100 ®83 SUBJECT: CLOSURE AND CONVEYANCE OF A PORTION OF DARCY STREET (UNOPENED) BETWEEN MILL STREET AND GRAHAM CREEK IN THE BONDHEAD AREA OF THE FORMER VILLAGE OF NEWCASTLE. RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, 2. That the unopened portion of Darcy Street between Mill Street and Graham Creek in the Bondhead area of the former Village of Newcastle, be closed by by-law and conveyed to the abutting owners; and, 3. That the value of the lands involved be established in the amount of $2,500.00 (Twenty-five hundred dollars) per acre; and, 4. That Staff be authorized to complete the procedure for closure and conveyance of this road allowance, in accordance with Town Policy. ...2 1.041 ry f Page 2 REPORT: WD ®100 ®83 J N. A petition from abutting owners has recently been received for the closure and conveyance of the unopened portion of Darcy Street in the Bondhead area of the former Village of Newcastle. The applicants and their solicitor have been advised of Town Policy in such matters and have complied with all of the necessary steps todate. The area of land comprising this particular section of Darcy Street is about 0.7 acres and the road allowance has no potential with respect to the Town's road system. Accordingly, it is of no use to the Town and its only value is that of additional holdings to the adjacent land owners. Town Policy states that an appraisal must be obtained prior to the sale of any Municipal Road Allowances. However, in this instance, since several other road allowances with similar circumstances have already been closed and conveyed, a base price for comparison exists. Earlier this year, Clarke Street, just to the south, was conveyed at a price of $2,500.00 per acre and, prior to that time, another portion of Clarke Street to the east was valued by appraisal at $2,500.00 per acre. As the land is of no foreseeable use to the Town, and since conveyance will free the Town from future responsibility for the land, closure and conveyance is recommended in accordance with Town Policy. Attachment P E T I T I O N C� For the closure and conveyance of the Municipal Road Allowance situated: All of Darcy Street, between Block E and I, and west of Mill Street, according to C.G. Hanning's Plan of Part of Lot 28, B.F. Concession, former Village of Newcastle, (former County of Durham), now within the limits of The Town of Newcastle in the Regional Municipality of Durham. We, the undersigned, being the owners of property abutting the above - mentioned road allowance, do hereby petition the Council of the Town of Newcastle to close same by by -law, and convey the lands thus gained, in accordance with the terms and conditions of the Municipal Act, R.S.O. 1980. Attached to this petition is a survey. We hereby agree that, upon Council approval of our petition, we will register the Survey, and will accept the responsibility for any costs involved in finalizing any and all transactions, as apportioned in accordance with the size of the parcels of land gained. We further agree to pay to the Town of Newcastle the sum of Two hundred and Fifty Dollars for the administration ofr7this petition.
