REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF JANUARY 16, 1984.
REPORT NO.: WD -11 -84
SUBJECT: RELEASE OF DEVELOPMENT AGREEMENT
D.R. AGENCIES SUBDIVISION, COURTICE,
PART LOT 32, CONCESSION 2,
FORMER TOWNSHIP OF DARLINGTON
REGISTERED PLAN NO. M -747.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That in compliance with the Subdivision Agreement
registered in Land Titles of the Registry Office of
Registry Division 10, Newcastle, as instrument
No.958, a certificate of acceptance for said agreement
be issued; and, -
3. That -the Town's solicitor prepare the necessary
documentation for the execution and final release of
the Development Agreement; and,
4. That the Mayor and Clerk be authorized to issue the
Certificate of Release on behalf of the Town; and,
5. That Ontario Hydro be requested to energize the street
lights on Windsor Valley Place in said subdivision,
and that the Street Light By -law be amended to reflect
the new area.

REPORT:
As Council is aware, the above subdivision went into
receivership with the municipal servicing not completed.
Council subsequently authorized the necessary actions to
complete the services in question and pay for same from the
developer's original letter of credit on deposit with the
Town.
The services were completed under the direction of the Works
Department and have been constructed according to Town
standards and specifications. Accordingly, a release of the
subdivision agreement, which will eliminate any cloud to the
title of the lots contained therein, is appropriate.
As part of the servicing, street lights and the associated
(` wiring were installed. These have not, however, been
energized pending the appropriate amendment to the Street
Light By -law. It is, therefore, recommended that such
amendment be made.
