REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF JANUARY 3, 1984.
REPORT NO.: WD -2 -84
SUBJECT: CLOSURE AND CONVEYANCE OF A PORTION OF DARCY
STREET (UNOPENED) BETWEEN MILL STREET AND
GRAHAM CREEK IN THE BONDHEAD AREA OF THE
FORMER VILLAGE OF NEWCASTLE.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That Council reaffirm the position that an independent
appraisal of the land value is not required.
REPORT:
On December 5, 1983, the attached report was considered by
the General Purpose and Administration Committee with the
recommendations being adopted. An amendment requiring an
independent appraisal of land value was proposed; however,
as I and others recall, this amendment was lost.

Unfortunately, the recorded minutes, specifically Resolution
GPA- 984 -83, indicates that this amendment was carried.
Since this misunderstanding could result in added costs to
the abutting land owners, the matter should be clarified.
It is, therefore, recommended that Council reaffirm the
position that an independent appraisal not be required.

SUBJECT: CLOSURE AND CONVEYANCE OF A PORTION OF DARCY
A— STREET (UNOPENED) BETWEEN MILL STREET AND
GRAHAM CREEK IN THE BONDHEAD AREA OF THE
FORMER VILLAGE OF NEWCASTLE.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the unopened portion of Darcy Street between Mill
Street and Graham Creek in the Bondhead area of the
former Village of Newcastle, be closed by by -law and
conveyed to the abutting owners; and,
3. That the value of the lands involved be established in
the amount of $2,500.00 (Twenty -five hundred dollars)
per acre; and,
4. That Staff be authorized to complete the procedure for
closure and conveyance of this road allowance, in
accordance with Town Policy.

REPORT:
A petition from abutting owners has recently been received
for the closure and conveyance of the unopened portion of
Darcy Street in the Bondhead area of the former Village of
Newcastle. The applicants and their solicitor have been
advised of Town Policy in such matters and have complied
with all of the necessary steps todate.
The area of land comprising this particular section of Darcy
Street is about 0.7 acres and the road allowance has no
potential with respect to the Town's road system.
Accordingly, it is of no use to the Town and its only value
is that of additional holdings to the adjacent land owners.
Town Policy states that an appraisal must be obtained prior
to the sale of any Municipal Road Allowances. However, in
this instance, since several other road allowances with
similar circumstances have already been closed and conveyed,
a base price for comparison exists. Earlier this year,
Clarke Street, just to the south, was conveyed at a price of
$2,500.00 per acre and, prior to that time, another portion
of Clarke Street to the east was valued by appraisal at
$2,500.00 per acre.
As the land is of no foreseeable use to the Town, and since
conveyance will free the Town from future responsibility for
the land, closure and conveyance is recommended in
accordance with Town Policy.
