(416) 263.2231 987.5039 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF JANUARY 3, 1983. REPORT NO.: WD-5-84 SUBJECT: M.T.C. LAND REQUIREMENTS FOR THE RECONSTRUCTION OF HIGHWAY 35 /115 AT STATION STREET IN ORONO, PART LOT 28, CONCESSION 5, FORMER TOWNSHIP OF CLARKE RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, 2. That approval be given to the proposal of the Ministry of Transportation and Communications to acquire land required for the reconstruction of Highway 35/115 at Station Street in Orono, more specifically described as Part 1, Plan 1OR1618; and, 3. That the land, being existing road allowance, be conveyed for the sum of $1.00, and the Mayor and Clerk be authorized to execute the Property Purchase Agreement prior to February 23, 1984, as requested by the Ministry. 1 ...2 7 Page 2 REPORT NO. WD -5 -84 The Ministry of Transportation and Communications requires a portion of the Station Street Road Allowance (Part 1, Plan 10R1618) for reconstruction of the Station Street /Highway 35/115 interchange. The land is already road allowance and only its designation will be changed through this transaction, therefore, the Ministry is offering $1.00 for the sale. In the past, the Ministry has paid the Town market value for lands which it acquired from the Town which were not road allowance. As indicated above, this transfer of land is merely for changing of designation, therefore, the Ministry's offer is reasonable. It is, therefore, recommended that the transaction be approved. Property Purchase Part 1, P- 2390 -76 Part Lot 28, Concession 5 Township of Clarke W.O. 7 -79 -13 Highway Number 35/115 Further to our recent telephone conversations regarding the above noted property, which was recently acquired by The Town of Newcastle from Arthur Henry McLaren Part 2, 1OR -1042. The Ministry requires Part 1, P- 2390 -76 for road purposes for the future reconstruction of Highway 35/115. Kindly review the Ministry's Agreement and, if acceptable, execute and return the original to my atten- tion. The land recently purchased by M.T.C. Agreement T- 21110, dated July 13, 1983 acquired lands that were not currently being used for road purposes. Parts 2 and 3, P- 2390 -71 were part of the Township of Clarke Patrol Yard and Part 9, P- 2390 -70 was part of an old railway right of way partially occupied by Mr. R. G. Moffat. THE CORPORATI'QN OF THE TOWN OF NEWCASTLE BY -LAW 84 -2 being a by -law to authorize the execution of an Agreement between the Corporation of the Town of Newcastle and Her Majesty The Queen, in right of the Province of Ontario, represented by the Ministry of Transportation and Communications The Council of the Corporation of the Town of Newcastle HEREBY ENACTS AS FOLLOWS: THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation seal; an Agreement between Her Majesty The Queen, in Right of the Province of Ontario, as represented by the Ministry of Transportation and Communications and the said Corporation, dated the day of 1984, which is attached hereto as Schedule "X ".
