SUBJECT: RILLS OF LIBERTY NORTH
PART LOT 11, CONCESSION 3, FORMER DARLINGTON
REQUEST FOR COMPLETION CERTIFICATE
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the Director of Public Works be authorized to
issue a Completion Certificate for those works
installed and completed in accordance with Stage 1 of
the subdivision agreement between the Town of
Newcastle and East Woodbridge Developments Ltd., as
amended; and,
3. That the maintenance period for the completed works
commence February 14, 1984.

BACKGROUND & REPORT:
On July 13, 1981, the Town of Newcastle entered into a
subdivision agreement with East Woodbridge Developments and
Mutt Enterprises for the construction of a residential rural
estate subdivision known as the Rills of Liberty, Lot 11,
Concession 3, former Darlington. A staging plan was
approved and Conro Construction Ltd., of Weston, Ontario,
was contracted by the developer to construct Regional and
Town services in Stage 1 of the subdivision.
In September of 1982, Regional Works Staff conducted a final
inspection of Regional services and found the work performed
to be complete, in accordance with approved plans and
construction documents. Regional services were placed on a
two year maintenance period commencing September 15, 1982.
At that time, works required to be constructed in accordance
with Schedule G of the Town's agreement were not complete.
On review of Schedule "G ", it became apparent that certain
works required to be constructed would be better left
unfinished until a future date. An example of such works
would be Section "G" 2, Roadways, which states that the
owner agrees to the grading and paving of all driveways to
the property line, in accordance with the Town of
Newcastle's Design Criteria and Standard Drawings.

The Rills of Liberty is a rural estate subdivision with
individually custom built homes, therefore, it is difficult
to locate driveways before the house locations are
established. In order to accommodate incomplete works such
as this, the Town entered into an amending agreement dated
June 13, 1983, which allows those works not completed to be
excluded from the Completion Certificate.
East Woodbridge have now requested that a Completion
Certificate be issued for the works constructed, to -date.
Public Works Staff have inspected the work and concur with
the request.
The final course of asphalt installed late last fall has
some minor deficiencies which are to be repaired by the
contractor in the Spring of 1984. When these deficiencies
are repaired, a Completion Certificate will be issued for
the final course of asphalt.
The Town presently holds a letter of credit in the amount of
$303,530.00 as financial security for completion and
maintenance of the works. It is, therefore, recommended
that the request of East Woodbridge for a Completion
Certificate for works satisfactorily completed, be granted
as of February 14, 1984.

RE: RILLS OF LIBERTY SUBDIVISION
Dear Sir:
Further to our meeting of January 16th, you are requested to grant
Completion Approval on the subject subdivision for those sections
of the works which are complete.
It is understood that Completion Approval for the top course of
asphalt is subject to completion of any remedial work required as
a result of an inspection to be carried out in the spring. However,
you indicated that provided this work was carried out expeditously
the top course completion date would be set to coincide with the
current Completion Approval (anticipated as February 13, 1984)
I have also requested that "as built drawings" be forwarded to you..
from Anton Kikas Limited this week. A statutory declaration
regarding payments in enclosed herewith. 1
